Read More.A luxury resort and spa company based in Singapore filed a UDRP against the domain AnantaraLuxury.com, registered to an Indian property developer company in 2020. Meanwhile, the Complainant filed to register the ANANTARA mark in India in 2019. The Respondent claims that they were not aware of the Complainant when they rolled out their “Anantara” brand. The Complainant disputes that.
The WIPO panelist noted that neither party was straightforward in what they chose to not disclose regarding their existing trademarks’ status:
