Determination
For the foregoing reasons the Examiner finds that the Complainant has not satisfied the burden of proof in respect of the requirement that the Disputed Domain Name was registered and is being used in bad faith, and in accordance with Articles 8.6 and 9.3 of the Procedure the URS proceeding is terminated and full control of the Disputed Domain Name registration shall be returned to the Registrant, without prejudice to the Complainant to proceed with an appeal, an action in a court of competent jurisdiction or under the UDRP.
