Can someone purchase and register a domain name that is the same as an online business but is differant in that it is ending in .co.uk. and not .com?

For example if there is a company called 'bigandlittlebottom', that owns a website and domain such as, 'bigandlittlebottom.com' is it legal for an 'individual' to purchase 'bigandlittlebottom.co.uk' if it's available?

Could 'bigandlittlebottom' take legal action against the individual that just bought 'bigandlittlebottom.co.uk' ?

The individual is not going to use the new domain name for business but maybe sell the domain at a later date.

Basically it's a registration in bad faith which also does stand on the lines of TM infringment because the word is not a generic word bu an exact copy. Could you reg it then yes. Could you run into complications most likely.

As far as im concerned thats just domain squatting. But question. Does bigbottmo or w/e own the TM rights? Did they buy them before or after the squatter regged bigbottom.co.uk? If you TMed the name, you can sue.

Ok. If the individual has bought this domain '.co.uk and the business domain name '.com' was up first then i suppose the individual will need to do somthing asap to avoid the business taking action. What should the individual do now? Can he just say he doesnt want the domain now. How does he release ownership of it? He wish he had never bought it now! :(

I suppose if one was to contact the agent that it was registered with they can cancel it as it was purchased only 8 or 10 hrs ago.

If the TM was in place before the person bought the .co.uk then the person must release the domain from what i understand.

Sorry if i seem to be dumb! I'm new to all this. But TM stands for trademarked /copyrighted, yes? And your saying aslong as they have not TM'd the domain name before the individual then it's fine?

Sorry but I'm really a virgin at his domain business.

HOW DO I RELEASE THE DOMAIN NAME??????
