i have a pretty tricky trademark question.

I happen to be a fitness guru and am working on creating a mega fitness website for women.

As you know, there are many words that are associated with fitness. Firm, Sculpt, body, and so on.

The domain name i'm thinking of using is either FirmDiva.com or FirmBod.com

The problem i'm having is that there is a company and/or set of fitness videos from Goodtimes entertainment called "The Firm" (firmdirect.com)

Do my names pose a trademark infringement?


Any opinions?

My take

Firm is generic in nature
Firm is a general term of fitness
You would be using firm with a word together for a completely different branding (as in "I'm a firm woman" or "I have a firm bod) It is more descriptive.

If you don't copy any of The Firm content or other TMs they claim, I think you would be in the clear. You best bet is to pay for a consult with a lawyer just to cover yourself on this one. But I think you would be ok.

BTW- I hope you regged the domains already.... :)
