Darn! Another scam and this time it is an experienced domainer James Booth.

James must have thought he was making a sound acquisition as he transferred approximately 26k to escrow for CQD.com. Instead, after completing the escrow, the domain was taken from his account by the registrar without notification and returned to the "true" owner.

Turns out the person that sold him the domain CQD.com, may not have been the true owner.

Apparently this incident involves several parties including the registrar and the escrow.

I feel you. I almost fell over when I saw that ROR.

You need to lawyer up or work with James to prove who you are and try to give him a chance to help you if possible.

You are fortunate that the domain ended up with a well known person that is aware and saying something.

Exactly if this name was stolen and went to an unknown party in China, most likely it was gone forever.

I think the ROR report is important because @BoothDomains might be looking to go to court over libel, it muddies the waters for an amicable resolution like @TheLegendaryJP was pushing for. There are a number of legal actions possibly on the table.

If someone buys any asset, property, whatever, under a scenario where they believe they purchased the asset in good faith they have stolen nothing. They might have to give something back but they are not a thief. Words have meaning.

Thank you so much for trying to make the ROR thread right again the best way you can, admitting we act out sometimes due to the anger at that time is only human. We have all been there and will again at some point.

No one is doubting you or your story, no one is doubting James thought it was you he bought it from and no one thinks if stolen you shouldn't get it back.

Avoid the back and forth with members who seem to be less than helpful, don't get pulled in or down by the use of words or phrasing. Stay focused on the task, it is worth it.

As mentioned if James is unwilling to help you uncover the truth you unfortunately need to get a domain lawyer.

So true so true, I also believe James is stuck because how can he even consider reselling this name, he is a stand up guy and what buyer would pay 5-6 figures for something that might be taken back when disclosed. Even bigger headaches for James as long as the threat looms, toxic asset atm.

Yes, and i suppose it will cost Rebecca quite a bit of moniez for the reputation damages.

That was a really bad move on her part. IMO

If you get upset and hurt someone, there can be very serious consequences.

what do you mean by gone forever?

this isn't a bar of gold that was stolen that you can melt or remove marks from .. if any existed... its a unique domain .. unique name and asset.. which is forever now marked as stolen... who will buy or make a website with it now? you can go after anyone who does make a wesbite with it.. how can thief sell it? no one will allow it on namejet.. sedo.. or other places.

its a bit like stealing an artwork. one of a kind unique.. retracable. domain is probably even more unique and worse.. for the thief.

Not looking to debate but trust me when I say this, I have dealt with it for many year and many domains.

1)Who wold buy it? Lots of people, ethics are a funny thing.
2)Gone forever? While not always true I can state that in my experience I have had much harder of a time recovering a name in a Chinese registrar for example, I have done it (ename for example) but much harder to get them to cooperate and then there is a jurisdiction issue. So essentially the statement "gone forever" is true.

my twin brother was on a visit from out west. i get to see him what, 5 days a year....so i took the time for me to spend time with him. oh, my pic is of my now dead 12 year old mare (young and full of life).
stolen domain = frazzled owner = missed the indicators = dead horse = buried in the yard.
(she was a beautiful horse).

  • People who cherish the secret hope of getting free TVs from James say Rebecca never had the TV and is lying.
  • People who hate Rebecca's horses and beer accuse Rebecca of being the actual thief.

Part 4 - Where saviors appear

  • Grilled (Mapledots) starts talking. He makes sense to some people.
  • The Legendary TV Guy appears. He shouts at the top of his voice and actually starts making sense to more people.
  • People who listened to Grilled and then to The Legendary TV Guy, now rethink.
  • The Legendary TV Guy shoves the ball into James' court.

  • Rebecca, seemingly well versed in the art of losing an audience, keeps counting the bottles of beer and recites horses' names when asked to tell the name and model of the stolen TV. Once in a while, she looks up and laughs aloud for no particular reason.
  • James is quietly flipping channels and binge watching drama movies.

Part 5 - Where people exclaim "oh my God she is making sense after all"
  • Rebecca starts posting screenshots of her stolen TV and its bills and transactions.
  • Rebecca still keeps discussing her horses. By this time, most people know them all by their names.
  • Rebecca manages to post details about her TV.
  • Tide turns.
  • A few people (see part 3) still keep grumbling about how Rebecca breaks her eggs on the wrong side and how that is very, very wrong.
  • Rebecca says she knew all along what James and some others were doing - shifting the burden of proof to her.

Behind the camera - 6
  • Google sees a spike in queries for "theory of reversal of responsibility"
  • James finishes binge watching drama movies, and looks at the CQD TV in front of him pensively. He sighs.

If there was a account setup for [email protected] (the "seller") on escrow.com, the account that the booth (the buyer) sale went through on, would i (the real [email protected]) be able to create a brand new account?

you can't create an account with an email address already in the system, AFAIK.

however, at least until Flippa.com bought Escrow.com, it was possible to change the name and email of an account without any checks from Escrow.com and, worst yet, that new information would get reflected on already closed transactions.

I don't know however since when has this issue been corrected.

it seems to me that Rebecca always used domain CQD.com and her official point of contact was from CQD.com. comquestdesigns.com comes in only in 2017 and I am betting that Rebecca was looking to sell the domain in a near future in expectation that the increase in offers on 2015 would eventually lead to a 6 figures sale (the money grows on trees). so, it is natural to anticipate that event and slowly move on to another domain/brand.

However cqd didnt get moved to a2hosting ns at any point until long after it left her possesion.
How does startlogic nameservers come into play, if it was still in her possesion?
