Bob Hawkes started an excellent blog post May 21st all about Zoom.com. In his blog post he stated there are over 2,400 websites with "zoom" in their domain name, and there are over 500 TM's also using a variation of the word "zoom"

Now for my question, I just registered a domain xxxxxxZoom.com and Zoomxxxxxx.com for a startup involving virtual tasting that I'm starting. Zoom the company is my vendor of choice for my company. I have other names I can fall back on if necessary, but I believe I can generate a lot of business for Zoom and myself with this name. Any thoughts or advice?

Note, i did not register the domains in "Bad Faith" as seen here;

The UDRP suggests that the respondent has acted in bad faith if its primary intent was to sell the domain name to the trademark owner or one of its competitors for a price in excess of out-of-pocket expenses related to the name. See UDRP 4(b)(i).

Zoom is such a common word that issues would only arise if you use or market the names in a way that infringes on an existing TM. If you just point them to a For Sale landing page, there should be no issue.

And remember, I'm not a lawyer. :)

(iv) By using the domain name, the domain name registrant intentionally attempted to attract for financial gain, Internet users to the registrant's website or other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsorship, affiliation, or endorsement of the registrant's website or location or of a product or service on the registrant's website or location.


The above examples are not exclusive and other circumstances may exist that demonstrate the registration and use of a domain name in bad faith.
Ironically the closest thing I was ever involved in with regards to "Bad Faith" was when a Philadelphia Lawyer and another NP member falsely accused me of being someone else that was actually found guilty of registering a domain illegally. And to think, I never got so much as an apology for such an egregious mistake. Fortunately I discovered not everyone in this industry had similar deplorable morals, so I just chalk it up to bad apples and sour grapes:xf.wink:

I received a nasty gram from a lawyer because I have the domain Circulator.org He sternly warned me that the owner of circulation.com (I think) would take all blah action against you blah blah. I emailed back and ask him if they thought circulation and circulator were dictionary terms, and other questions, he never responded. That said, I have Zoomiest.com over at BB and thought of the similarities to Zoom as they became a household word in the last 3 months (another case for having the right name, as ZoomMeeting etc may not helped with their success as much as zoom)

Haroon...you can have legal issues with any domain you register. I started this thread, but I have all the domains i need using the keyword "Zoom". If your intention was/is more scientific to "zoom" into rock or stone formations you should have a decent defense, and most likely you could trademark it. However, if in "Bad Faith" your intention is/was to promote the new "zoom" technology, you probably have a big problem.
