my tiny zune portfolio...

Don't these domains infringe on somebody's trademark?

Did you check at uspto.gov before you registered?

IMHO if you register domains containing a trademark you're asking for a herd of lawyers to knock on your door. Can you afford that? You need deep pockets...

yep, thanks beverly..When I registered these a few months ago nothing was trademarked in relation to zune whatsoever..if you check the threads the points you are trying to make have been made 100 times ad nauseum, cheers for your concern but this is an appraisal thread.

...err, it MSFT is well on their way to getting a trademark on 'zune':

This has a very definite impact on your appraisal request. You can't make money out of illegal trademark usage for very long ;)

IMHO you could probably sell your domains (on eBay) for $100 each to someone who doesn't understand intellectual property law.

Well, TM issue domains might be good for profit but I see them as nothing but potential trouble.. even if you sell them, you can be sued after the fact for any profit you made, despite the fact you no longer own them. It may be an appraisal thread but you can't make an informed appraisal without pointing out the obvious: TM's hurt the value considerably.

thanks for your appraisal,
Ill be sure and warn these guys of the TM issues they have overlooked

ipodconverter.com
planetxbox360.com
ipodupdater.com

...ad infinitum

Well, as has often been said, just because there are hundreds of other domains with TM issues, it doesn't mean you're safe or even legal.. two wrongs don't make a right.

granted...just not in the mood to debate an issue that has been gone over so so many times...to work trade marks into an appraisal is obvious, appropriate and necessary...just seems sometimes there is a fine line between an appraisal and a flaming hijack. A comment on TM and warnings of deep pockets with no appraisal just doesnt seem like an appraisal to me. The same info with an actaul appraisal (as in post #5)..obviously is an actaul appraisal and is very much appreciated, as previously stated. FYI the first (and only) time I ever owned a domain which was an obvious and actual infringement ( a XXX.net) I immediately contacted the rather large company and notified them and "I" requested that they permit me to push the domain to them for free, even though I had considerable offers for the domain, the company did not even know about the domain who I was or that I had it. They were so appreciative that they decided to reward me quite generously with product.....ie I am not a sqautter/ransomer, and I do not deal in legally "dangerous" names...I understand of course that "Zune" appears in the domain names above...same way it does in the thousands on afternic/sedo etc and the myriad of zune domains which are already popular established sites...but you are right as you say, even 8,000 wrongs dont make a right....If it would help the thread stay on track, as I hate fidley TM threads...you are both right, I am wrong, please forgive me. If only VB had a de- bump function lol

Not wishing to add fuel to the fire, but by complete coincidence (?) MSFT decided yesterday to start suing what they call "Cybersquatters":

Wow. Good post.

I was going to rant about how this should remain an appraisal thread and even though there are TM issues at hand, it should remain just an appraisal thread. However, after reading the Forbes.com article... I believe you should take the advice of putting these in auction on eBay.

Even though law doesn't prohibit Msoft from coming after you in the future for profits made, it sure will take the spotlight off you. Besides, I have yet to hear a case of this actually happening. Regardless, the best advice in the world would be to get rid of them ASAP.

I used to own FerrariUSA.net, after receiving a letter in the mail about cybersquatting, return address labeled "Ferrari North America"....I sold it. Havn't had any problems since! And, it's been years now. Apparently the guy who bought it isn't as afraid of legal problems...or he has a LOT more money than me!

Good luck.

IMO, pointing out that a domain has TM issues (which could potentially render it valueless due to legal problems) IS an appraisal. The title of the thread is "Your Thoughts Welcome". I shared my thoughts on the matter...

Undoubtedly, he may never have a problem with this domain, then again, he may. Either way, it doesn't change the facts... TM domains = potential problems down the road.

Can someone tell me this?

They call it cybersquatting because you sit on the domains until the company wants/needs them? am I right? they say your not doing anything with them your just waiting to get money from us for them. am I right?

now correct me if im wrong

What if you don't keep them and the domains are in constant movement from domainer to domainer? can that be called cybersquatting?

I don't see much potential...perhaps $xx at the outside!

If you own a domain containing a trademark, or HAVE EVER OWNED a domain containing a trademark, you run the risk of being sued by the trademark owner. They can sue you even after you've sold it on.

Q: Do you want to take the risk?
