Hi guys, i put up my domain Amicale.org on godaddy auction on Sep,11,2019,
howere,my domain amicale.org was against the trademark said by one of their staff and not allowed me to auction again.

honesty speaking, i really got confused their such behavor,.

amicale is a common french word which means CLUB or ASSOCIATION as well as widely used on the net in french language areas, trademark?

I have sent their several emails but they do not get me back yet.

Any thoughts will be much appreciated!

The bottom line is we don't have to list any name we don't want to on our site. No amount of emails to the teams is going to change the decision they made. We don't make legal determinations on the validity of trademarks. The legal team here said don't list that domain for sale so we don't. The term amicale has two live trademarks in the US that I found without much effort. You might not like that, or you might disagree with that, but the bottom line is we're not going to list it. We are not a court and we are not going to listen to any arguments about the validity of a trademark claim and determine if we can list it or not based on an argument. If we feel like there is a risk to us in listing a domain we won't list it.
We are not making any determination on the validity of you to own the domain or for you to sell the domain or anything like that. That is between you and your legal counsel to determine. We are simply saying we are not going to sell it because we are not comfortable with the risk to us for allowing this domain to be listed for sale on our site.

i have sent you 6 emails and yet there still any no response and at the same time there is no refund as well,due to the Feathered domain services
I see no reason we would not give you a refund unless they didn't understand the request. If you send me a private message with your account number I can make sure you are issued a refund.

While a team and some brand products use the term, as you point out it is a generic term in French and geographical. Have you pointed that out in case the person handling your file did not realize? Interestingy GoDaddy sold on their platform a domain name including the term just a few fays ago.

I hope that you will get a private response from GoDaddy although comment by them on a potential TM on a public board would not be appropriate, probably.

It takes at least a few days to get a response. You need to have extreme patience or you will lose your sanity. Keep your emails very concise and only cover one topic at a time.

They move slowly for a tech company but I'm sure they'll refund you if they offered to sell you a featured listing, and you accepted their offer, and then they changed their mind about listing it.

That seems like a super reasonable thing to want a refund for. I'm not their biggest fan but I'd be so surprised if you're on the hook for a featured listing fee for a name you aren't allowed to list.

All you can really do is count down the days until you can transfer out. In the meantime, you should be able to list it in other marketplaces. Check if it'll list on Afternic :)

Beyond that, there's nothing you can do and there's no point worrying about it at all. GoDaddy can be incredibly frustrating to deal with. It's a rite of passage. You aren't officially a domainer until you've had a negative experience with GoDaddy.

I can put it up on SEDO.COM for sale ,but it made me mad is that they dont give me a refund due to the feathered services i took recently or get me back via email!
Refund for what, a premium listing, how much do they owe you, I think if they refuse to list your domain you should get a refund. I think your refund maybe got lost in translation, but maybe you can ask the Godaddy rep here to look into the refund as it seems warranted if a service was not provided.

a while back i tried to list 't-r-u-m-p.com',rejected. they said it was a stand alone word that was tmkd. with all those hyphens,really. i said it was a dictionary word and no one can actually own the word, as long as they stay away from the tm niche they are safe. still no good. a few weeks ago i tried again with 'applead.co'.this time i had a word with apple so i should be safe,another rejection. tm issues again. then i explained it was not pronounced 'apple ad' it was actually 'app lead'.no good. it's currently under review at afternic. wonder whose side they are going to come down on.

I don't envy their job and accept what @Joe Styler says above that it is their decision what they will list on their platform. Being so huge is difficult no matter how well run to be consistent.

Your case is interesting @cabotower in that as AppLead it seems totally generic, yet AppleAd not.

It is interesting that Verisign today proudly promoted on their blog that the 5th most registered .com keyword last month was Airbnb. Seriously!

I hope if you can't use their service you will get a refund for your premium fee @VaneZhao. If I could offer advice ask for it as unemotionly and politely as possible to increase chances of success. They have ruled on not listing it so nothing to be gained by refighting that. I hope the premium charge at least works out for you.

I think the reason is simple. They don't want to be blamed, and be part of a legal action. They lose nothing, but they lose time, if such an unlikely thing happens. You can't list keywords like, trump, paris; but you can list hiltonhotels.tld at Sedo. Because hiltonhotels.tld is not a hot domain if not com, and noone cares. Also they may be trying to protect their reputation. If you ask me, any domains should be allowed to be listed, except criminal sounding ones.

I have listed my domain AMICALE.org into the sedo.com for sale and i also do much appreciated to those whom they are warm-hearted in the thread(y)(y)(y)

Sedo has no problem to list well known TM domains. Most recently they have listed Realtor.global in the auction. I tried to point it out, but they redirected me to their legal dept. so I just moved on.

i have a few domains who can not be listed at sedo
they are detected as a trademark

same goes with a lot of trademark,
you can't argue with tm database

just move on
by the way amicale .org is a steal at that price,
it is the case where .org work better than the .com
OP should focus on finding a good buyer

I tried to buy a name like retailshopping or shoppingonline years ago and couldn't due to TM it was the most generic combo in world for online business and they were enforcing TM on it so nothing surprises me now.

BTW,AMICALE IS A COMMON FRENCH WORD which means CLUB or ASSOCIATION ,and you will find hunreds of thousands companies use this word if you google or bing ,whats more,the word ranked within 10000 common words in French according to the Collinsdictionary.
CAN your team explain us What are common words or what is Trademark? The word AMICALE belong to the US company only?

Whats worse, they dont gave me a refund even though 3 days has gone so far!

honesty speaking,im so ,extremely,disappointed about your services and the poor services i have met compare to other registars!
