Hello all,

I recently registered weightwatchers.in when I realised a few moments later that the name weight watchers is probably trademarked.

Is this the case and any suggestions on what I should do now?

I don't think that name is trademarked since it's very general.

It is TM in the US,So is weightwatchers.com

Errr... check out these USPTO search results...

I didn't run a search in India for TM issues, but I suspect this is a very touchy registration.

Your right it is trademarked. But with it being an Indian domain that might be a little different.

Perhaps. Weight Watchers runs their affiliate programs (for their US, Canadian and UK operations) through Commission Junction, and they are quite explicit in their T&C with regards to affiliates. Their affiliate TOS includes provisions for keyword bidding on PPC systems, as well as clearly defined AUP for their TM names...

I think it's an interesting, but touchy, domain...

when it may be or is trademarked?

Well if it is trademarked i would sell it to the company that own the TM.
Thats my opinion.

Well, the best way to do it is not to sell it, but simply inform the company about your registration and you tell them that you are willing to settle for an amount that reimburses your registration cost because you understand that the name is trademarked and you were not aware then.

This "friendly" method should go well, instead of trying to profit off of some's established trademark, which could potentially cost you everything you own. Another way would be to simply let it drop upon expiration (in other words, don't do anything); if in the interim the TM holder notices and contacts you, then just hand it over. If you're *really* worried, then you can contact the .in registry and ask them to cancel your registration; you won't get a refund, though.

To be honest with you, I doubt weightwachers is really concerned about your .in , mostly because there are not that many overwieght people in india. i doubt the traffic stats will be that high

I don't really know or give a damn if there are fat people in india but I am sure there are since the eat LOTS and LOTS and LOTS of stuff that ain't good for them....

Well it may not be registered in your country.. Try looking through your trademark db.. Just search Indian trademark db on google or something.. They may not care if you have it but they may.. No body really knows.. You could also try selling it.. Let somebody else have the probley ;)

weight watchers DOES run an affiliate program via commission junction....

but you have to be approved into the program

I'd develop the domain with weight watchers friendly advise....and then join the affililate program.
