I'm fairly new to domaining and am trying to learn as I go. I recently acquired a domain HairBlend.com from a drop. I just discovered that this name is trademarked by Solaray for a health product.

Can you give me advice about the name? Does the prior trademark present a problem? How does valuation work for a name such as this....and where would I go to fetch the best market price..if that is feasible?

Thanks,
Sandy

Good chance it dropped because of a C & D letter. If so, you can expect one also. So, I guess your best market price will be -$$ .( Whatever you paid for it.)

I don't understand why it would have dropped due to a Cease and Desist. Being that it is a .com I would imagine that the trademark holder would want the domain and if a C&D existed the domain would of transferred to them and not dropped.

I was previously involved with a lawsuit with BuyDomains.com where they held a domain which I had a trademark on. The last thing I wanted was for it to drop and someone else get it then I would have to go thru the courts all over again. I wanted and got the domain.

from a drop? what i read mostly their advises about this issue, is to let it drop, if parked then unpark it.

Not all TM holders want to reg every TLD they can. But, they don't want them used so somebody can ride their coattails. So, they issue a C&D, and if that doesn't work, they sue for damages.
If you have deep poxkets, like it sounds as if you do, and can afford a suit, by all means go ahead. They may not sue you.
You asked for an opinion and I voiced mine. :D

Should companies have to registered a million version of their TM and typos just so "domainers" don't register them? It is up to the domain owner to do their due diligence and not register TMed domain BEFORE they register the domain. It is stated on every domain registration agreement. With that said, usage of a registered domain can go a long ways. But I did see "How does valuation work for a name such as this", well, it seems you are looking to flip the domain for a profit, that does not look good on you. Always try to cover yourself.
