Tos coverage?

I’m going to make a site(depending on the advice in this thread). The site is going to be like BeHidden.com, now BH(behidden) does not have a tos which can hold them responsible for a lot, however this is my question. If a user is using my service and I make it MANDITORY that they click that they accept the tos(this would be done with cookies) and the commit cc fraud or some other illegal action, but it is clearly stated in the tos that they must be the age to be able to held to a contract legally(I believe this is 18) and that the action is not allowed on my service would I be held accountable for this users action or could i get in trouble?
