Hi All. I have a very good domain name related to 'The Beatles' and would value any feedback. I have done trademark checks and based on the actual domain name it can only be used to market Beatles songs I have been told it should be fine. Would anyone consider a domain like this as a potential investment to enter into there portfolio with a view to using or selling it on? Any feedback whether positive or negative welcome. Thank you

Without knowing what the domain is its impossible to advise you.

But I will say if it has the potential of a trademark infringement, I would stay away.

Indeed there is a big risk at TM domains.

Who told you this?

Titles are not protected by default; however, if additional commerce attached the it gets protection.

So for example t-shirts, posters, lunch boxes etc. If the single was a hit then it mighy also have TM commerce protection - this covers most Beatles songs.

Also copyright might extend if the song is original. i.e. Crazy might be too generic but Nelly The Elephant (great tune) is original.

It would be an obscure song imho to not be a problem. The problem likelihood increases if the site is profiting FROM the recognition afforded it by the beatles band.

I would think any interested party looking to invest $$$ would be needing a decent legal opinion and\or clear usage with the song rights holder (still the Jacksons?)

Its definitely not
"no issue"

I think you're right and i incorrectly read. Phone surfing sucks.

Its probably along the lines of BeatlesSongs or something.

If its a bonafide business focused only on Beatles memorabilia you can be ok based on nominative use...

But the answer is still a good lawyer as you say.

If its the name in your signature 'BeatlesBestSongs.com' then your trademark searching skills need improving.

I wouldn't describe that as good - it needs a "The" or a reorder.:music:
