Yes. But when listed in the marketplaces / auctions, wouldn't it be easier for them to raise a concern and claim it? Even if you are not contacting them, what if someone else contacts them to negotiate with a hope of buying the domain from the seller at a lower price... Just checking the possibilities.

Trademarks are for specific categories. Having a trademark in one category doesn’t stop anyone else using the same name in another.

The specific case of someone front running names is a small possibility that in most cases isn’t worth worrying about.
