ATLANTA (AP) - A federal appeals court early Wednesday agreed to consider a petition for a new hearing on whether to reconnect Terri Schiavo's feeding tube.

The ruling by the 11th Circuit Court of Appeals came as the severely brain-damaged woman entered her 13th day without nourishment.

Schiavo's parents, Bob and Mary Schindler, have maintained that Schiavo would want to be kept alive and have asked the courts to intervene. Schiavo's husband, Michael, insists he is carrying out her wishes by having the feeding tube pulled.

LOL....Being a bit harsh on the parents are'nt ya Zurax,I think her parents love her very much,Despite all the differences in opinions,You got a think about it,And this is just reality IMO,Her parents actually seem to be greiving more at this point,A parent losing a child takes years to let go of,Call it selfish or whatever.I hope they win thier case,IMO again,Terri deserves the right to live.

There in lies the problem,We don't know that her wish is to die.Her husband says it is,And IMO his credibililty is not good.He has a new lady in his life,He has two kids by her,Therefore IMO,He has givin up his rights to make any decisions for her.I know,That's not what the law says,But,He has moved on with his life,Why is he so caught up in to terri,Love and comittment? Nahhh,He has his comittment with his current fiance and the two kids he has with her.So what gives? Maybe money for him upon her death?

Hope her parents LOSE because her husband will just get it removed yet again then she will go through all the starving yet again.

So if I am sitting there with my wife, if I was married, and I told her I wouldnt want to be kept alive like that and a year later I had an accident and was a veg. She shouldnt be allowed to give me my wish?

It's amazing that people can argue what they think is the best way for people to live. There is no one right way for people to live.

That being said.
Those that want her to live, don't seem to mind that she is suffering while living.

She is going to suffer either way. I don't buy the idea of not suffering while being starved, but I don't have the medical degree to back that opinion so it remains just that, an opinion. At the same time, I don't wish anyone to have to suffer in such a condition. Terri once knew what it was like to run and jump and play and sing, and dance and love and feel joy and drive down the street to the park and swing and be free. All of these things most people take for granted. It's easy for us to sit here and damn the parents, or damn the husband, or damn the system, but I bet it would not be so easy to be in their situation and feel their pain. My Grandmother passed away two years ago. She was blind due to illness, she could no longer walk, she could no longer use the bathroom by herself, she could no longer care for herself or her husband. She suffered every day towards the end. When she died, everyone was sad because we all loved her very much, but at the same time we were glad that she wasn't suffereing any longer.

To say Terry should be forced to live is to say she should be forced to suffer.
Try putting yourself in her place before you pass judgement. Who cares what the parents think, who cares what the husband thinks. They are not Terri, they are not living her life and going through what she is going through.
People should stop pretending they know what is right for someone else because that is a dilusion. Live your own life and let me live mine. And I'll do the same for you.

Yeah, and her compassionate, loving husband who's made sure she dies by starvation. Give me a break, it's a joke to call the parents the bad guys in this situation. A complete joke.

People are all over the parents for trying to save their daughter. No one here (that has shared, at least) has a daughter in the same or similar situation that I have seen. It's funny to me that you take a guy's hearsay that she said "_______" over her own parents who have been by her side for years and years. Yeah, I'm sure their psychos who love to watch their daughter in torment - all of those years and now want to watch her starve. That makes perfect sense.

I'm sorry, but you're basing court decisions off of hearsay, and that makes this whole thing a joke. I feel horrible that Terry has to suffer either way, but given the conflicting medical opinions there really isn't a clearcut answer to the situation. I find the husband's motives a bit shady in this situation and why prevent doctors who say they might can help from seeing her?

ATLANTA (AP) - With time running out for Terri Schiavo, a federal appeals court Wednesday rejected her parent's latest attempt to get the brain-damaged woman's feeding tube reconnected.

Nearly 15 hours after agreeing to consider an emergency bid by Bob and Mary Schindler for a new hearing in their case, the 11th U.S. Circuit Court of Appeals rejected their request.

To be granted, the request would have needed the support of seven of the court's 12 judges. The court did not disclose the vote breakdown, but the order did say Judge William Pryor did not vote because he is recovering from surgery.

Three times last week, the court also ruled against the Schindlers.

In requesting the new hearing and a court order for their daughter's feeding tube to be reconnected, the Schindlers argued that a federal judge in Tampa should have considered the entire state court record and not whether previous Florida court rulings met legal muster under state law. The Schindlers' motion also said the Atlanta-based federal appellate court didn't consider whether there was enough "clear and convincing" evidence that Terri Schiavo would have chosen to die in her current condition.
