If you are going to state that you had a bad experience -- then why not tell the whole story?

You were suspended due to violation of our TOS. Nothing more. No hidden agenda. We gave you three chances to stop the spamming on the vps. But all we recieved as a response was- you can't control it.

If you going to go and reply this on every post that Shouvik or I make.. Then all I ask is you include why you were suspended.

We have been in business for over 6 years and we value our customers.

Why where there, why don't you tell everyone that I was conveniently terminated just a couple of days after renewing the account, or that aside from the suspensions I was always sending in a ticket every few days because sql was crashed on server and HyperVM wouldn't let you login, or why don't you just post the url of the other thread so people can make up their own minds about the quality of the hosting.

You threaten us will not get you a refund.

You were suspended due to spamming not because you pay an invoice..

There is no hidden agenda here.. We have been in business for over 6 years.. we wouldn't be if we ripped off our customers!

FYI: we suspended your account not terminated it. There is a big difference.

We suspended your account so we could stop the spamming and notify you.. which we did every time. Your response was "I have no control over it".. Well first you have control over it and second you are responible for it.

We as a company are not perfect, never said we were.. But we take abuse seriously. But while taking it seriously we gave you three chances to remove whatever script was doing the spamming. It didn't happen.

by the way, why the hell are you advertising proxy hosting if your so anal retentive about spam, mosts experienced proxy hosts know that proxyies can be used for sending spam

There is a difference between SPAMMING OF EMAIL and web proxy servers. Proxy servers for SURFING -- not spamming. Even if you setup a proxy for email -- you know that would cause spamming which would inturn be against anyone's TOS.

I don't believe stopping abuse on our servers is "anal retentive".. You may think that but I would believe most hosting company wouldn't think so.

FYI: we host other proxy vps-- we don't have a spam issue with them.

First off we would not demand 2 months of a hosting fee to "look over your code" -- who told you that?

Also we don't know how many sites you had on this vps. We don't monitor the number of sites on someones unmanaged vps!

You could have had 4 or 20 sites -- it didn't matter spam was coming from that server and it needed to be stopped.

This is getting downright silly.

I'd like to read your TOS, now obviously this is sarcasm on your part. I'd like for you to take into consideration some factors:

Spam is illegal and detrimental to all web users.
Spam is a controllable action based on technical experience.
Web Surfing Proxies offer the capability for a user to remotely view a website. This has absolutely nothing to do with sending out spam mail.
You were asked multiple times, with multiple tickets about taking action on the spam being sent out from your VPS.
Every response on your part was "I have no control over that"
We offered to resolve this at a fee for you... completely reasonable.
You also did not want to comply about that.

Based on the quantity of tickets, time delays in your responses, and repeated requests and offers of assistance to help... another billing cycle had passed through time... hence you had paid another bill while going through this ordeal. There is nothing "convenient" about that.

This complete abuse is about to end now.

You are officially being told here and in a private email sent to you that this slander and tyraid is to cease and desist.

Feel free to CALL ME at any time... +1.631.503.6010 to discuss the actions we will to take to insure this no longer carries forward.

The address we have on file will also receive an official C & D Letter from legal counsel.

The ball is in your court. You lost $9 that paypal found in our favor after your failed Chargeback attempt.

You will soon receive other bills, legal fees, etc if we are required to send out Cease and Desist Letters going forward. Please check with your local jurisdiction and authorities as to what rights you have and Court Claim processes in your local area.

Please lock this thread as it is off topic. Looking forward to hearing from you... if you do not call within 72 hours, we will automatically send the Cease and Desist letter to the address on file without confirmation... Legal fees will be assessed from that point forward.
