I'd be interested in people's thoughts on this.

.com is developed bug-spray product. Among other things, this domain could be used for a rock climbing website.

BTW, Great Domains did offer to list the domain for me. Any guesses on the suggested listing price they gave?

Nice short dictionary word. Love it :).. even with the .net extension this is worth quite a nice amount.

Trademark a factor?

When someone trademarks a commonly used dictionary name do they have the power to prevent others from using it? Even if the website focused on different types of products that "repel" insects, would that be wrong.

I can understand not using trademarks like "Compaq", "Google", "IBM", "Ford", etc.

I cannot understand how someone can "trademark" a dictionary word out of usage by the rest of us like "computers", "golf", "defeat" or "repel."

Any legal professionals out there who know?

It's not anything different than the folks at Apple who have trademarked "Apple." You would be able to use the business name "Apple" as long as you are not in the same area of business (e.g. computers, Ipods, etc.). My domain, repel.net should be 100% legit as used for a rock climbing site.

Can someone please explain to me how rock climbing is related to this domain? I have no idea how you people have related it to.. please clarify it for me :).

Repelling is like coming down off using the rope and pushing off the walls as you progress down. It's pretty much the act of lowering yourself using a wall / gear.

Nice name fonzie -- the rock climbing angle will most likely pay better than the mosquito angle. Very nice pickup.

I agree that used for rock climbing is perfectly OK if it were spelled the same. (In rock climbing the term is spelled "Rappel." But my point is that Apple Computers went into the business of selling the Apples you eat then could they prevent people from using "apple" in their advertising, web names, business names.

Everyone but the Apple company would have to call their products "those red, green or yellow fruits commonly used to make cider"

You could not have a business called "Mom's Homegrown Apples"
or a website called "apples.com" or even "CookingApples.com"

Can a company trademark a name that is a common term for all it's competitors. Could someone trademark "repel" and prevent anyone from using this term who develops products that repel insects.

So again I pose my question can a company just by a trademark limit the use by everyone else of a common term in that industry? Any legal eagles out there?

its a negative word, so needs a different angle. IMHO go for anti-assailant pepper spray type of stuff, or alternatively bottled armpit cologne D-:

$50 dollars a sniff.

I think it could be used as anti-virus, but that's just me. Probably would go for $xxx but I think you should hold out for low $x,xxx...there's bound to be an end user interested in it.

Before I listed this domain for appraisal, I submitted it to Great Domains. I'll disclose if the domain was accepted and if so, what the suggested listing price was in another day or two.

funny, the first thing that came to my mind was mosquito/bug netting/screening

advertisement on the radio
"Get Your Repel Net for only 7.99 a square meter @ repel.net, ..that's r-e-p-e-l, dot, net"

wouldn't be an infringement on the bug spray as there are many ways to get rid of bugs ..sprays, netting.. or .. *smack! gotcha!

Yup, agree 100%. It's a dictionary word, so as long as you don't plan to sell insect repellants, you should be 100% ok!

I missed that as well. Never knew rock climbers spelled it differently.
