Removing Credit on GNU GPL Wordpress Theme

I was just wondering, if I am using a free WordPress theme that is under GNU GPL, but the creator's website has that we cannot remove the credit line in their Terms of Service, which takes precedence?

States:

* the freedom to change the software to suit your needs,
* the freedom to share the software with your friends and neighbors, and
* the freedom to share the changes you make.

But if the creator's site says "Removing our credit links or reselling our themes without permission are not allowed.", does the GPL or the creator's rights overrule?

Can I remove the notice?

Under the GPL you can do what ever you want to make it look different, But you can not remove the original copyright.

You can change, move, or edit things and share with others, but the copyright has to stay intact.

I have bought a lot of premium themes and premium scripts which allow you to remove footer links, I have also paid creators of free themes and scripts for the right to remove the links from the footer, so another option would be to contact the creator and see if they would give you an option to buy the right to remove the credit links from your site.
