Would be so if the .com wouldn't have been a gaming company. Haven't checked but they probably hold the TM in that category.

Thanks Guys for chipping in ...
There's no TM at present for any Gaming Company as per uspto website.
And beside, i think .net is much cooler than .com when it comes to Gaming Apps.
