.mobi Question regarding reserved names

I have registered some names that are the plurals of reserved names, not necessarily intentionally but with the plethera of names out there, it was inevitable that many would be registered.

The question is if a domain was released onto the market with a singular name and the plural was already developed, where would I stand legally?

Does the plural of the domain name become the premium valued domain?

Naturally I don't want the name taken from me as that would tend to irk me :)

There is nothing on the main mobi site and have printed their entire site to pdf for my records.

I have heard nothing. Since the domain is already registered and if there is no current TM. Than there should be no issue.

Newton - I heard it argued somewhere on the forums that registered non-premium names are safe. And it stands to reason that the registry intentionally left good names (singular versions, etc.) for landrush registration to help get the extension off the ground. From a legal perspective, the registry forfeited future claims to "premium status" by having selectively identified and released their public list of chosen premium and reserved names. The ones we obtained through hand reg/auction were legally available for registration and thus become protected investments by virtue of our time and capital expenditure in acquiring and developing these available names. In essence, the dotMobi registry sold/leased them to us and now we have a defensible stake. Should be fine as long as there are no TM issues.

Both the singular and plural versions may wind up perceived in the market as "premium" like: apartment (non-prem, obviously valuable) and apartments (premium), or home (non-prem) and homes (premium). The singular and plural versions of generics co-exist in all extensions too.

Note that there are RESERVED names and PREMIUM names.

Reserved names will not be released as per agreement with ICANN. For example SanJose.mobi is reserved and will not be released.

Premium names are being withheld by mtld and will be sold at auction or put out for RFP. For example, hidden.mobi is a premium name.

Just thought you would like to know the difference.

i wonder if those reserved will ever be released ?

i think dotmobi should work to clarify that because it would mean a lot

i see that newyork, newyorkcity, nyc are all reserved, which means people could start building business models around alternative spellings such as nycity.mobi (taken) and then perhaps see newyork.mobi released to the public would be a real bummer

sid, have you got any clarification on what will be done with these

i notice palmsprings isn't on the list, wierd, i don't get

as for the premium list, i have looked that over and honestly, i believe that was put together by a couple of drunk irishmen with sex on their minds because there is no logic at all to that list

All I know about the reserves is what is says on the mTLD website:

i just sent them an email asking for a clarification

does reserved mean held back permanently or
does it mean reserved until some unspecified future date?

I spoke to Pinky Brand and the woman (forget her name now) who is the legal counsel for MTLD. They both told me very clearly that Reserved names are reserved by ICANN for cities and countries.

So, MAYBE if a city or country want to develop them then maybe. Otherwise, they will not be released to the general public.

sounds a little haphazard to me, is there any order to the names they kept back, are they all the really big cities, because there are a lot of city names not on the list

i think for big cities, the opportunity will lie in all the subcategories like food, pizza, rentals etc

i got an email this AM from a dot mobi person and he said the reserved names will be held back at least until all premium names are gone and that will take through 2008
