So what would happen if someone outbids $7000 (outbids sony if they are the bidders) and win the auction.Can sony then steal the domain from the new owner as pspgo will now be a TM?
No, Sony would not have the power nor right to "steal" or take the domain from the new owner. Sony would have to prove that the domain was registered in bad faith.
Check this, it clearly proved the domain was registered and being used in bad faith. Actually the domain has been spammed at another domain forum for a while. If $7k is a genuine offer, it must came from Sony. I wish the sale can go through, but it shouldn't be seen as a positive case.
The original owner can make that argument, but a case can be made that the new owner has no right to claim prior use since they didn't buy it until after the TM was established.Sony would have to prove that the domain was registered in bad faith. That would be extremely hard to do especially as the domain was registered back in April 2008 (over 1 year ago), long before the recent rumours and official announcement of this new portable video games system.
