On Monday I'm listing ePepsi.com on eBay. Any guesses as to what the final auction value will be?

I'd love a basic appraisal or guestimate but with a little eBay twist.

The domain is worth $0 since it a clear TM issue. Domains like this are not worth the risk of owning.

I agree. TM issue is not worth it. The logic that "other people do it" is flawed.

Just because someone doesn't get caught doesn't make it a crime. Pepsi, Apple, etc. can't be on top of every infringing domain, 24/7/365. There are companies like MarkMonitor who do specialized in these sorts of things, but with millions of domains out there, and tens of thousands being registered new every day, sometimes things fall through the cracks.

In this case, though, you're going to be in a lot of pain if Pepsi finds out about this. There are mildly-infringing domains, and then there are blatant TM infringing domains. This falls into the latter category. My recommendation is to run away, grace delete it if possible, and then bury your credit card in a deep, deep hole until you've read up on all of the legal issues related to domains.

ePepsi lol maybe pepsi would want this but they can just take it from you, dont know who else would want to start a pepsi related blog lol sorry!

People will begin to learn when the registrars have to start being liable for selling these TM's that they are so aware of. When there are NO consequences, of course, the SKY IS THE LIMIT for the registrars and the fall guy is the sucker who buys these domains. :hehe:

I wish you the very best with regards to your domaining endeavors however, I would highly recommend playing it safe and not speculating with regards to company names, trademarks etc.

Generic products and services in the main extensions are a pretty good bet.

I used to call some of my French Canadian ( Quebecer ) friends Pepsi's so it could refer to that.

I guess I'm kinda a Pepsi myself, kinda.

To give a clear response to this comment, in the vast, vast majority of cases, this reasoning does not remove the problem of trademark infringement. Read up on the concept of trademark dilution, which says that even non-commercial usage of the term can still be infringing. The rules on fair use of trademarks is much, much more strict than fair use of copyrighted material. Trademark law doesn't work on the concept of "I think this...", it's a strict set of laws and court decisions that don't care one bit what you thought was the correct answer.

The fact that you said in a public forum (which has probably been indexed for posterity in all major search engines) that you're listing it on eBay can easily be used by their lawyers as proof that YOU intend to profit from the name.

Drop it like the hot potato it is.
