Hello all!

I have aquired the domain Photoshop2.com i know there is a *possability* of a trademark issue but i am interested in finding out how much this domain would be worth.

It is definately a trademark issue. So would not keep my hands on it.

The buyer must have guts to buy this one.

Might work for an authorized dealer of Photoshop software, or develop for Photoshop tutorials.

Great idea. I would have also done the same if I were the owner of this name.

If you put tutorials even if 10 or 20 of them which are available for free. Then no one can touch you.

I didn't say that. Adobe may or may not take offense with the use of their trademark. They've gone after typo versions of their names before. link Who knows if they would take offense if it were developed into a tutorial site? You could always try asking permission first.

Yeah RJ but then you have some grounds that you were not in mood of making fast money and pouncing on their names.

Most of the cases that the trademark company wins are when the domain is just parked.

You can goto court and then ask for 1 million saying it was you development cost.

That's it. But you should have proper ground for it first.

So this TM law...does it work for ANY person with trade mark?

If i was to go and trademark a product...lets say its called hello, could i then take the hello.com domain and clame that it should be mine because it has my product name in it?

Yeah, you're right about that. If a name is simply parked or listed for sale, its almost automatic grounds to lose it should a TM dispute arise. Making a legitimate use out of it is important.

most companies have better things to do than shut down fan sites.

Trademark?

No,there are no TradeMark violations by you owning the name,lol. PhotoShop is a retail product that is sold at many stores,a la Staples,Office Depot etc.So if you are planing to sell the product using that domain and/or link to it there are no trademark violations.
I do not understand why so many people think by registering a "TradeMark" name/domain name you can be sued.This is true though in many cases,but the trademark owner will have to prove that you registered the name in bad faith,intent what have you.They can not sue until the website of the domain is developed.So dont worry,keep the domain.
Now if PhotoShop offered an "Affiliate" program then you will not be able to use the domain.But if you are a retail seller of the software then you can use the name and if worse comes to worse,you can always foward the name to a non-trademark domain name.There are many ways to beat the system..lol.So in my opinion if you find another "TradeMark" domain,GRAB IT!
The name is worth GOLD! Keep it! LATER!

This might be a dumb question, but if Photoshop*2*.com is worth so much, in your opinion. Then what's to stop people from registering Photoshop3.com? And why wouldn't that be worth as much?

It could possibly be because of CS2 being released, but who says they aren't releasing CS3?
