Mozilla Wins Back Infringing Domain

Firefox developer Mozilla has reclaimed an infringing domain name that was filed in bad faith.

The World Intellectual Property Organization (WIPO) Arbitration and Mediation Center last month that the registrant, which had concealed its identity by means of a privacy protection service, had registered mozilla-europe.com in bad faith and that it was identical to Mozilla’s trademark, bar the descriptive term ‘Europe’.

The registrant had also registered two other domains with well-known third-party brands, including beatsheadphoneschapoutlet.com and ottawaredcross.org.

Further, sole panelist Carolina Pina-Sánchez said that the respondent had no rights or legitimate interests in the domain and that it couldn’t “conceivably assert that it is commonly known by the term ‘mozilla’ given the notoriety surrounding [Mozilla’s] trademark and the fact that it is exclusive associated with [Mozilla]”.
