They will always let you use their name in the domain in such cases as it benefits them and the site is favorable. That is why you see so many sites with the name of a company in their domain name: it benefits the company with free advertising, but when it is a site that is against them they will always find you and threaten to sue you. So because of the nature of the name you can not even receive the reg fee, at least from someone that really wants to keep their finances straight and reputation clean.

Both ICANN and the Us gov. under the Anticybersquatting Consumer Protection Act, have decided that if you sell the domain for a profit, and they find it was done in "bad faith" (as defined by ICANN) the same as if you were using the domain yourself, that you can be sued for any profit you made from it + an additional amount in damages that I believe can be up to $100,000 :td:
As many pointed-out, alot of this happens and the companies don't make an issue out of it. Most don't becuase it actually gets their name out there (sometimes bad press is better than no press). But is Bill Gates someone you want to play against

I am certainly not convinced that there are pure TM issues unless the site pretends to be a microsoft site. however such a site if developed would be checked for slander and it is here where you would need to be very careful. The name could be interpreted as slanderous in intent.
