Even though its not been released the name will be announced in todays press release - sadly a lot of good domains (.coms) are taken however I managed to get the below.

in my opinion there arn't, if these sites offer resources for the new OS then I dont see a problem.

Example of XP sites which have the xp os in their name and which I own the vista alternative

xpemail.com (i own vistaemail.com)

and so on.. nearly all of my vista domains are similar to the XP ones which microsoft allow.

Well, if you are planning on putting resources on them then you will be fine but if you plan on selling it for it money, then you might have TM issues.

Wait a minute, why would there be TM issues with the word Vista? Even vista.com is not owned my Microsoft - other companies have been using them.

Hmm, so your saying it would be fine if I didnt make money from the sites? So in theory no advertisements / I cant sell the sites heh .. I dont think so.

Windowsos.com got sued out of their operation. You might want to get a few billion dollars behind you to back up your case when they sue you for all you've got ;)

It was rather a shame, though, since I kind of enjoyed that community.

Yes, Windows is an estabilshed TM but "Vista" cannot be, as it's a generic term -- that's the difference.

I agree that the TM issues are tricky for the lawyers on this one: they did not choose a unique name...stupid, IMHO

Law suite i will put $100 down on it that you will have to get rid of them once those sites get big.

Mike Rowe, made a website called MikeRoweSoft.com they took the domain name away. Dont try it, just let them expire.

Mike Rowe had the problem of sounding exactly like the parent corp.

"window view" is a common term.

I'd like to hear from the Lawyer from Philly on this one...

No TM issues. "Vista" is too general a word to TM. It's used everywhere. There are at least a dozen businesses in my area that start with "Vista". THere are 3 raods that are named with the word vista in my area. there are 4 apartment developments thaat use the word Vista in my area. And there is one mom& pop computer builder in my area with the word of Vista in their ficticious business name.

On the otherhand, do not be surprised if MS tries to scare you with a C&D. They can sue anyone for anything. They have the money to do it and they do.

Actually, htey did not "take" it form him, they bought it from him for jsut a few thousand. Initially, they were going to court over it but both parties decided to settle out of court.

Personally, I believe that the kid should have gone to court and counter-sued for all fees he incurred should he have won.

I believe that Mike Rowe would have won the case becasue MS did not TM the sound of "Microsoft". And as far as I know, you cannot TM the sound of a word or proper name, but i could be wrong. They simply just scared Mike Rowe into thinking they could win the suit. Mike Rowe, from what I understand, was a minor so it was very easy to scare him into thinking this.

Funny thing I just found.

mikerowesoft.com is owned by MS however, the site that is hosted on it is not an MS site.

Also, mikerowsoft.com is not owned by MS nor is it owned by a guy named Mike Row.

TM issues or not, I see no value in most of these domains. Especially vistamp3, email, cd, files, and hyphen -forums.

BTW, singular forum is best for just about any forum related domain.
