The winner of the last 1,000 pixels, which sold for US$38,100 on eBay, is threatening to sue because the Web site was offline for six days until Wednesday, the Financial Times reported in its online edition on Thursday.

It was his fault.
He failed to buy ddos hardware protection.
If I paid 38k+ for advertising and the site I was advertising on was down I would sue too.

Its his job to protect his network from hackers, did he think this sort of stuff wouldnt happen?

Its a shame for the poor guy but he should have realised its the internet! These things happen.

I have never understood all the hostility being directed toward this guy. He had a novel idea, made a lot of monney with it, and now people (here and other sites) have bashed and trashed him and his site. DDOS attacks are very hard to prevent, and major companies with whole computer departments and a host of programmers have failed to prevent such attacks on their own networks. The suit is hilarious and if he wants her off his back, he can refund the money she spent. He's still ahead by several hundred thousand dollars (not a million due to expenses) I'm sure.

It's publicity - but as you can see from replies, not always good publicity. People that purchased some pixels (obviously) aren't too happy about the site's downtime as they paid for a LOT of exposure - and they feel they should get more.

For all of you who think it was his fault... apparently you do not realize that he cannot control his server's security when it comes to the best types of firewalls; hardware router firewalls (I think that's the correct term...) - even Google fell (a couple times) for a few hours to these DDoS attacks. You shouldn't condemn him like this...

He chose not to get hardware ddos protection so yes he is responsible for not doing everything possible to prevent downtime.

Some people paid a LOT of money for this advertising. They have a right to compensation if the product is not offered.

Don't pitty a f*cking millionaire. He HAD and has the money to buy proper security for his server, and he has FAILED to do so because he's too busy spending it all.

Someone needs to sue him, for all he's worth! >:(

What possible justification could you have for suggesting this?

Put aside your childish jelousy and think straight. He should be held responsible for downtime but to suggest that he should be sued for "all he is worth" is immature and absurd.

don't pitty the sue'r because he probably hardly cares if he wins...hes just trying to get money (in/out) of court
