Just to clarify, on which cases the usage of 'mac' should be considered as a trademark violation? There are some sites with similar domains, like macthemes, macrumours, iphoneapps, etc. If Apple bothered, can they file a lawsuit against these domains?

I think lots of domainers on this forum are obsessed with tm issues. Not being an expert on subject, they damage every discussion by the tm remarks and hurt the legit domain names.

Yes, the name uses "mac", but it legitimate name for a site that will be producing/selling/distributing etc. third party apps for mac and mac would be happy for somebody do that work. So how would you name a project that produces apps for mac? apps-for-u-know-who.com?

Anyway, if any domain is used in bad faith, there can be issues.

i just read an article on a company who have been told to drop the name of their best selling app , ripipod or ipodrip (cant remember) , it backs up files and is a the companies best seller , but apple have decided they dont want the name associated with them , the company feel they are in the right , but stated they cant afford to fight them on this issue

In this industry, being obsessed with TM violations can only be a good thing. Better to be safe than sorry. Reward = Saving yourself & others from possible $XXX,XXX lawsuits VS. Risk = Poor Forum Appraisals or Undervaluing possibly TM violation domains? Is it really a question which side to err on?

As domainers it is important to bring awareness regarding Tm issues, for the good of our livelihood.
Also wether people like it or not, the issue is being focused upon throughout the industry. Search engines, advertisinging, domain parking companies, as well as trademark holders are more keen than ever to stop cybersquatting and typosquatting. Domaining as an industry is fighting to be recognized as a reputable business activity and not a rip-off, scamming activity.

It is only responsible in my opinion to mention any potential Tm issues to anyone asking for appraisals, and then it is up to them to check up and decide what to do.

Many people are new to domaining and know very little when they first start. Its a learning curve that everyone goes through.
