Please help me understand why domains with ipad in them are bad -- but there are hundreds of ipod related domains?

They're bad because of the blatant TM issue. When someone wants to sell a domain name containing a TM keyword (Google, Yahoo, Microsoft, etc), it's obviously that keyword that gives value to the domain, otherwise it'd be worthless and meaningless (if the same TM didn't exist, nobody would be selling domains containing it).

(i) The Domain Name is identical or confusingly similar to a trademark or service mark in which Complainant has rights; and

(ii) Owner has no rights or legitimate interest in respect of the Domain Name; and

(iii) The Domain Name has been registered and used in bad faith.

ie:- IPADgames would satisfy the confusingly similar part of any claim.

You will get people on the forums who may have been members for long time, telling you that these names are ok, and that they have had names like these for years with no problems.
Just because they have not been caught, ( YET ), does not make it legal.

Agree! I think that when a newcomer/starter asks questions about TM domains, we should say them they're always illegal. Period. If we all did this way, I think newbies wouldn't be registering so many TM domains.

Just use some common sense with these types of domains....It really comes down to useage.(IMH experience). For example, CokeMemorabeliaCollectors dot whatever or HondaTunersAustin etc. may or may not be deemed as TM infringments depending on the specifically stated identification of goods and services of the TM'd name in question. Again, this is only my opinion based upon first hand experience.

The interest in a product that may or may not attract a tm problem can be overcome by simply going for the generic terms of Tablet PC/Computer (a few still available) which is what Apples ipad is.
