In order to have prevented so much madness associated with all the good .coms being gone largely due to domainers, trademark issues, etc., here's how it could have been done:

One .web domain allowed for every registered organization and government entity (proof of documentation from a Secretary of State for non government entities). No .com since every legit entity is an organization.

One .web domain allowed for every person based on social security numbers, passports, drivers licenses, etc.

Only one extension, so no confusion.

First come, first served. If any organization missed out, they may need to change their name or get another .web variation. This beneficially prevents overlapping business name confusion.

What about real estate? One home per person?

Are you Kim Jong-Un?

I believe in freedom so long as it doesn't cause extreme hardship on others. Domainers cause extreme hardship to businesses.

One home per family is better for the environment, so yes, people who own more than one home are causing unsustainability.

Internet is causing hardships for millions of retail stores? ever thought of that? TONS have gone out of business, lost everything they had, you solution? Force everyone to buy things in retail stores to at least once a week or face the guillotine?

But you said you are a domainer too :)

What kind of extreme hardship have you personally caused to businesses ? You might want to talk to a priest perhaps ?

I'm referring to extreme domainers like Frank Schilling. I have maybe about 20 domains. He has about 500,000 that many businesses are prevented from getting.

Basically, it's called capitalism. Capitalism is part of the framework of democracy. But democracy and capitalism can be abused and become predatory.

One way to control excessive abuse of capitalism, is by putting regulations. Without regulations, perhaps most companies in the US would have been controlled by Chinese and Russian tycoons.

When a resource is limited in supply, some kind of regulation must be enforced. Like for example, IP addresses are very limited, so there is regulation on how much IP addresses a certain entity can own.

However, with thousands of domains dropping every single day, it may be hard to justify that domain names are in limited supply. If you are a business entity that needs a domain name, i don't know why you would want to insist that you deserve to own a beautiful domain name, instead of the thousands dropping every day.

A beautiful domain, is not necessarily a life-and-death resource that you cannot live without. So therefore, you cannot demand that you should be given the best, when there are other domains available that you can use.

You have to remember, Frank Schilling's domain collections are practically worthless (besides parking revenue), if he has no buyer. An antique that is priced at $1 million, will not give you revenue by itself if it remains unsold.

The thing with Trademark, is that it comes from two root words = "Trade" + "Mark". Which would practically mean, that a mark is being used for "trade" or commerce, which is why it is protected for its uniqueness in order to maintain "fair trade".

However, human names are not normally used for trade. Which is why it is okay if you name your child as Bruce Willis. But if your name is Bruce Willis, and you want to enter show business via Hollywood, they will most definitely ask you to adopt another name. They will force you to use a different screen name, they won't necessarily have to compel you to change your legal name.

When it comes to domain names. If Frank Schilling owns a generic.com domain, i don't know why you need to complain. You can register generic.net or .org or .info or .biz.

The fact that ICANN allowed the creation of multiple extensions to exist for the same domain, means that people can use IDENTICAL domains. Nobody is stopping you to reg a .BIZ if it is available for reg fee. So why complain if someone who owns the .COM is selling his domain for thousands of dollars? Don't buy it.

The "premium-ness" of a domain, was created out of mere circumstance. It's all in the mind. There is no shortage of domain names that would probably require some kind of regulation of ownership.

I would think that if they really wanted to regulate .COM ownership, then all registrants must show proof that they are a government-registered company to begin with.

The only way you can acquire brand protection "to be used in commerce", is to acquire a Trademark.

To "acquire a trademark" is as simple as placing "TM" somewhere near the mark used in commerce. No registration fees or forms are necessary, however would obviously be helpful in the expensive sunrise period to secure domains.

sometimes when I see the asking price that some people come up with it gets pretty mind boggling, check this guys asking prices, https://www.afternic.com/listings/277907#

but again, in a free capitalistic world he can ask whatever he wishes, and I have a right to laugh, suspect him of heavy drug use as he came up with these prices, and I can go buy other names.

It's only mind-boggling when you are a newbie. But as time goes by, you start to yawn and feel sleepy every time you see it.

A true mind-boggling, is when money actually changes hands..... especially when you feel sorry for the buyer. lol

even more mind boggling when I make an offer for a name, it gets refused, just to pick it up when it drops a few months or a year or so later, im talking about 1k+ offers

How about eliminating parking and increasing the renewel fee to $100. That would make in unfeasable for people to own tens of thousands of domains.

They've done that with premium names and .rich, etc. My life.tips costs $250 per year! so far.

And how do you plan to recover your money?
going to shows and telling others who are sitting on names that will never amount to anything that he owns blahblahblah.blah

I enjoy the domain for development, not so much for resale. I hope to find a registrar (hexonet.net perhaps) to switch to that charges a lot less of a premium fee.
