That is a very simplistic view, and not how TMs work.

Harbinger is a generic word.

There are multiple uses and end users for this domain.

Tough to price. Worth what a buyer is willing to pay.

It's a common English word, so not a TM violation in itself.
It would be a good movie name or game name, or a good brand for fashion, alarm or security systems,health monitors,etc. Depending on the end user, anything from low xxxx up.

i think you are missing the point - there are more than a dozen active "harbinger" TMs, so nothing prevents you from:

a) registering one more (not intefering with live ones)

b) having a domain or a site with Harbinger in its name if it does not violate any existing Harbinger TMs (you can sell apples from apple.tld with no problem from TM point of view -- correct me if i'm wrong here)

c) sell the domain to one of TM holders or anyone who wants it - that would not violate anything including TMs


Parking the domain AND profiting from TM holders ads on it would be violation thou

it sounds like we are all mostly on the same page. the trademark issue should not be a concern, as long as the website is not used for a purpose that causes confusion in the marketplace of an existing trademark.

as far as price, it does seem like it's up to what the buyer is willing to pay. if anyone has anything further to add, by all means do.

Well, maybe the people who owns the TM could be interested, although I'm not sure whether offer the name to an TM owner is legal or not, maybe if you register the name before no problem, but I as a said above not sure but if no problem would be good idea

So price? from 2k + and speculating. I don't know if you have receive an offer ever, so you should speculate and of course the time you are willing to hold the name would play a rol

^^^I was kind of thinking this too. Engage the trademark and legal section of this forum, see if you can get a dialogue with one of the better attorneys who post here at NamePros. If I owned a game, software company etc. called Harbinger, I would very definitely be interested in this domain. But I would take a cautious approach in how to breach the topic. The age of registration obviates any TM claim, but approaching them directly might well be considered (or spun by attorneys into) a bad faith issue per UDRP, since there is zero chance that any of those companies were unaware of the existence of Harbinger.com and made the choice to not approach you with an offer.
