Hi Again

I've had someone contact me who is interested in buying the google.eu.com domain name (Yipee!)
What he has asked me though, is if it is actually legal to own this domain name?

Any advice please

If you are not a lawyer, and I guess you aren't, I would not venture an opinion on whether it's legal or not - lawyers and "courts" earn and spend $$$$ on such decisions.
I would suggest you tell them to date you have had no approach from anyone concerning its legality but that if he/she is concerned, you suggest they employ the services of a lawyer.
Then if they are still interested agree a price.

My personal opinion, (and I am NOT a lawyer), is that I think this name is a "no-win" situation and the best you can get is a few dollars from someone who may well end up unhappy - you must decide if it's worth it

It really depends on if the owner of the domain is using the domain to infringe on the trademark. With a name like Google, I would be hard pressed finding a use that didn't infringe. That being said, it is not automatically illegal to own a name that may be indentical to an existing trademark.

.eu.com domains do not fall under the UDRP per say, but Centralnic does have it's own policy. Here is a good link that may answer your questions about trademark infringing .eu.com domains

Hi

Thankyou SO much for all of your help and advice.

I have explained the situation to my prospective buyer, but another question that he has asked me is if it is legal for someone who lives in the USA to own a .eu.com domain name.

I was unsure, as I tried to register a .ca name recently and wasn't able to as I live in the UK.

Does anyone know please?

Yes, anyone can own a .eu.com domain.

Some country codes have nexus requirements (like .ca, .it, .us), but .eu.com is not an official country code.

RJ is right. .eu.com isn't an official country code.
But in 2004, .eu will be one.
I didn't heard something particular about that but i guess it will at least needed to live in one country of the European Community.
As said, .it, .fr or even .es have strict rules and if you didn't live in this contry you have to proove that you own a company in.
As said also, stay away from this kind of extension as their value will going undergrount with the new .eu.
