hmm lets see here poeple make a big deal out of TM issues because you can get sued if you use a domain that contains a TM violation. Litigation doesn't necessarily come only thru misuse, threads like this are spidered by Google.. excellent evidence now exists regarding his bad faith registration (intent to to trade on the the Google TM).
