First in first served?

Hi I am registering a number of new domain names that are not currently trademarked, trying to guess the future trends and so on. Now if one these names happens to be trademarked AFTER i have registered them as a domain then I assume it's a case of first in first served similar to being the first person to peg land in the goldrush??. The seems like common sense from here I hope.

This seems to be up in the air.

General feeling is that the domains will need some form of development. An earlier reg date may not be enough if the domain is just parked or 404.

Yeah it's a grey area that will one day be tested I'm sure. They will all be 'under development' in that I will sell them to a developer one day
