Looks like he isnt even a registerd ebay member anymore? Did you contact Ebay about it? How long has it been? No contact by him at all? Im not sure how the buisness check deal works but what about there support? Could you reverse the charges? Or stop the payment? If all that fails Id say file a fraud claim, $1300 bux is a lotta cash..

I email him many times, and here is the latest email i got from him on Oct 25 2006:

1. I once again refer you to the quoted terms, in the auction and in my many emails to you. Those terms quote the 10 days to clear personal checks, and shipment approximately 20 business days from receipt of cleared payment.

2. From the very beginning you have been combatitive despite the fact that it was your mistake to ignore the very clear statements in the auction.

3. This was the first line in the auction item description: “PLEASE READ ALL TERMS AND PAYMENT DETAILS BELOW.”

4. Since all this would be obvious to any impartial person I find your attitude unreasonable.

5. I made note of your threat and have taken appropriate action. Do not threaten me again - I guarantee that will produce a result not to your liking.

6. If the tv is not shippable to you by Monday I will process a refund. If you want to wait any further than that let me know.

Rick Rosner

after receive this email from him, i decided to wait til Monday, but its now Tues afternoon and i still haven't heard from him.

The check was payable to:
Richard Rosner
6060 Galahad Drive
Malibu, CA 90265
United States
(310) 589-8710

Could anyone please tell me what to do to get my money back. It's $1,469.73 includes Shipping. Should i contact FBI about this?

Yeah.. I ordered a DVD recently from someone on eBay with 98% feedback... never got the item and only got my money back after I filed a claim thru PayPal. I never bothered to look at the feedback but turns out this ebayer is averaging over 100 negs a month for slow or no delivery! Their total number of sales is in the 1000's tho hence the 98% feedback.

Shortly after I filed my claim, they set their feedback to Private then begged me to remove my negative feedback.

That's not all, shortly after I received my refund from them, I got an email from them asking for payment on the item!

It only takes 1 bad apple to spoil the barrel.. good luck on the TV. I'm betting given the large shipping window that this guy is a dropshipper.

You know its usually a bad sign when people set their feedback to 'hidden'. BTW, how were you scammed by him? Best of luck. ;)

And personally I think having the abiltity to hide your feedback is BS.

I know.. what's the sense of having a feedback system if it can be circumvented by blocking it?

eBay Australia is going to stop sellers with private feedback shortly, which is definitely a good sign down here. There should be no reason for a seller to legitimately hide their feedback.

But the whole feedback system has too many problems to be very trustworthy any more. Too many sellers refuse to leave feedback until after the buyer does, and f the buyer leaves a negative, no matter whether it is deserved or not, the seller will immediately leave a retaliatory negative. Then the extortion attempts begin, where the seller will try to convince you to agree to a mutual withdrawal... Too many regular eBayers are so hesitant to leave anything other than glowing, positive feedback that you can't trust a lack of negatives as a sign of a good seller these days...

Exactly.. the first time I left a neg for defective goods.. the buyer left a retaliatory feedback insisting that sellers should watch out, as I'd cheat them! Considering I'd paid, then received defective goods, and no refund or satisfaction, how did/could I cheat anyone? eBay should not allow that sort of unfounded feedback in any case.

The only reason eBayers hide their feedback is because they have something to hide.. a bad reputation.

If this guy/gal is stating at least 30 days for shipping he/she is likely building sales to place bulk orders offshore....or he/she deposits 1k to 2k form 50 or 60 buyers a month and yields interest he can keep. Then refunds those savvy enough to legally knock his door.

I hope all works out for you.

When paying such a big amount on ebay there are two ways to do it. Either you use an escrow service or you pay by paypal and fund the payment with a credit card.

On every single paypal payment you can choose how to fund the payment. Paypal doesn't allow you to set CC as default but you can choose CC manually on each payment. If you had followed that route you would now just call your credit card company and cancel the transaction. But of course you couldn't do it since seller didn't accept paypal which is one alert. The other thing that should warn you was his hidden feedback.

People who sell adult items or collectors items hide their feedback. But also people who have just received a nasty negative hide it as well.

Because you paid by check and the seller has waited untill the check cleared you have almost no chance to get your money back without getting police involved in this.

Take all the print outs you can, including emails you received from ebay after the transaction (something that shows sellers address) and file a claim on your local police. You must not wait too long. You seller looks like he is running.

There are countless stories like yours on ebay forum:

This is exactly what I was thinking. Not sure if you have called Ebay yet, but I think it would be a good idea, once you go to your local police to have a report # or something similar from ebay that the police can use.

I saw something like this on the news the other day. Some teenager (19) was selling stuff through eBay, but he would ship out empty boxes and pocket the money. He eventually got caught and was arrested.

These scammers are pathetic!

Since it looks like he was a powerseller, I would investigate further and see if you can report him to the BBB. Being a powerseller, he must have a business license to operate.

If all else fails, you can take him to the small claims court, though it's going to require you appearing in person.

hope you get your money back.

Hi,

On ebay.com website there are ways to contact ebay team. Do that immedietely... That should have been the first thing to do. Help get it from ebay.

Don't delete any of the messages you two have used to contact each other to buy the item. Ebay might need them to verify certain information.

Thanks all. I didn't tell my family about this, but i glad that i did talk to my sister in law. She is a lawyer, she told me she'd see this guy in court and get me back the money.

She's working on it.

We know where he lives, we have all emails from him, we know his domain names, we reported to the cop in here IL and in CA ( where hes living).
I paid by check... so either way we can fnd him very easy.

I can't wait to see his face in court... i'd show you all how he looks.

Thanks!
