Hi,
I registered the domain peterpaninscarlet.com on the 19th jan 06.

I have received the following letter:
As you may be aware, Great Ormond Street Hospital are the legal owners of the copyright in Peter Pan, as bequeathed to them by the author JM Barrie. We have recently commissioned an official sequel to the original novel, whose title was officially released to the press and general public as Peter Pan in Scarlet, on 20 January 2006.

Our legal department has bought to our attention that, prior to the official announcement, you purchased the domain name www.peterpaninscarlet.com - a domain in which , as far as we know, you have no legitimate commercial interest. If this is the case, we would of course reimburse you for the amount you paid for the domain.

We take our trademark protection very seriously, especially as Peter pan provides much funding needs.

I look forward to hearing from you as a matter of urgency in order that we may resolve this issue as soon as possible, in an amicable way.

As I registered the domain before the offical announcement do I have a case?
Also would I have any case if I wanted to promote the book?

:imho: If you bought the domain before the books announcement, if I were the judge, I'd say your right, but im no judge obviously :D

snail mail, is the normal letter by post-it's a snail mail as it is slow compared to email :)

do you think there are any trademark issues as it contains the word "peter pan"?

They are a charity, give them a break, give them the domain :)

They are offering to pay for the cost of getting the domain. I would take it.

With their legal powers they could just take it from you for nothing.

No. I suggest donating the domain and trying to get a link on their site to one of yours.

They are a charity so give it to them, if it were a domain name that would be worth alot then obviously kep it, but i cant see much value and it will help ill children etc.

"Peter Pan" is trademarked and appearently, there is a book in the works called Peter Pan In Scarlet. So the question is, when was the title first developed? I bet it was way before January 19th. This is a classic case of squatting (and the reason for our bad name). Also, I bet the lawyer have screens shots of your bad faith usage of the domain. Your best to cut bait here.

You did everything wrong on this and there is no turning back time to do it correctly.

Great Ormond Street Hospital do some great stuff in helping kids, I reckon you should sell it back to them for the reg fee.

Well it's only $8/9... you might as well donate it to them, that way you can at least feel good that you did something benevolent today :) Unless of course you need the money...
