i need a pro advise on appraisal of my domain ( www.DiamondClub.us )
i already have offers as high as 8,500 USD but i am not in hurry to sell. i will wait as long as needed to get the highest money for my investment. i know the value of my domains and diamondclub.com & .net is with http://www.harrahs.com which is very big casinos & hotels and they present Diamond Club to theirs members
my domain is very VIP and in every field of business they have a diamond club like airlines restaurant hotels..and many other clubs exist in USA.

Well, it would have been better to take under 10K if there's a chance you'd have to give it up for free. If one of the mark holders gets a bee in their bonnet... it can happen. Registering a domain name in bad faith is called cybersquatting, and it's against the law. You can find out more through the following link, or searching google.

Thank you for your replies actually, it is a common name and every one can register it with another name as trademark ( like somethig diamond club ), i can't sell it again to my previouse buyer because i told them that i am not going to sell it under 10k.

Not all appraisals include numbers. You say that you've gotten an offer of $8500... but if that offer was from a holder of the trademark it only means thats how much the name is worth to them. If they don't want to pay a higher price for it, they may attempt to file against you, to try and take the name.

Anyone else, doing the proper due diligence, will find that there is a tm on the name and may not be willing to purchase the name at a large sum, in this case 10K, if there is a possibility that they will have to relinquish the name to the rightful mark holder.

Now, if you were planning on using the name to create your own "diamond club" that had nothing to do with what is already marked, you would probably be ok... but you specifically stated the you're holding out for more money... and you named the industry which uses the brand, so I doubt you have any plans for development.

yes you are right i have no plans for developing it i hope to sell it @ 10K also i cant get that 8,500 offer back so may be if i get another offer i would sell it around 8K
about the TM, they can never take back this domain because it is general name for every field of business

the name is not a TM itself many names which contains diamond club has been registered and each company and organization can create any club with any name.
so there is no problem,

Maybe you will be ok but you would need deep pockets to fight Casino Lawyers.

Why you didn't take an $8,500 offer beats me, you may have to wait forever to get another offer of that amount.

i am a jeweler and i have registered diamondclub.us for my personal interest also i have noted that this is very unique domain name, i have a friend which he is a jeweler too, once he offered me 8,500 for site and design instead of some jewels that cost 8,500 but i have refused it & i asked for 10K cash.. if you go to diamondclub.us you will forwarded to another personal website of mine which is for gems and diamond, and i am selling certified Diamond and Gems.....
