Hi

I am very new to all this and i went and bought a domain name:
www.facebooksafetyforkids.com but now think it is a big copyright infringement? can i still use this site if i don't monitize it?

This domain is not a copyright issue, but it is a major trademark issue.

Nothing good is going to come from dealing in these type of TM infringing domains.

Well you have it for sale already on a parked page.

So yes it's a full blown trademark violation.

Drop it.

Above and the added problem of FB not wanting you to speak for them as to the safe use of their site. Even well intentioned, you can say something that's wrong for the safety of kids. At worst they can be afraid your trying to contact kids through their name. In other words its totally worth it to FB money wise to go after you on this one. Too late to grace delete it, you will have to do an old fashion godaddy hard delete. Goodluck.

If you are not going to make money out of it, perhaps it is better if you just create a Facebook account page, or maybe a Blogspot talking about facebook safety for kids. That way, you will also avoid paying renewal costs on both domain and webhosting.

There is clearly a TM issue if you bought it for resale; however, if you bought it to develop into a site about safety on facebook (which is a legitimate subject) then you would likely be ok as long as you meet some basic criteria:

1) You don't attempt to confuse or mislead with respect to your relationship with Facebook
2) The site is predominantly about safety on Facebook (and not other general advice)

I believe that the idea that if a domain contains a TM it automatically is a big issue is not accurate at all. That said, avoiding these names avoids any consideration of the issue. It could be a big liability - even if unlikely - and it's simply not always a risk worth taking. Domainers respond generally in a manner that assumes "if you intend to profit from resale" etc. There's a lot of peer pressure to make public displays of being against what is considered bad domainer behaviour - but overdoing it in some cases.

If you produced a site on Facebook safety? I don't think there would be much to lose sleep over as most people would NOT assume it was related to Facebook - it's perfectly descriptive name of what the site is. Don't expect any friendly emails from Zucker though.
