Hi everyone,

Any thoughts on bings.tv

I have a few first name tv's as well as the odd one with an "s" on the end.

I notice that Microsoft have the .com in this one.

Any views welcome.

Jimbo owns Bing.tv - He received big offer from Microsoft. He registered it prior to their trademark as a "brandable" domain. I think he kept it and did not sell it to them.

This name on the other hand it a blatant Trademark domain. Your post clearly indicates Microsoft may have interestes, a clear bad faith misuse of the domain.

If it is still in the grace period, get a refund.

Reg fee. IMO.

This domain does not have any value. I would let it drop unless you have specific development plans for it that don't relate to the search business.

As it happens, I did study "Law" when I was in my early 20's back in 1980-82.

(I had a gut feeling then, that it might come in handy for future business situations).

When you say, get a lawyer, I wonder if you mean, from the point of view, that “Microsoft” will not be happy with me.

If that is the reason you mentioned the “Lawyer”, then I can only say, “ I did not register the domain name Bings.tv to get business from appearing to be a Microsoft look alike web site.

I registered it to fit in with my other “Christian name domain names”.

I have to say, “Microsoft themselves, would be on a tricky wicked, if they went after all the Bing domain names, especially if they were owned by the “trademark” holder.

I see “Microsoft are being sued at the moment from a small St. Louis-based web design company called “Bing Information Design!”

I have looked on the “united States Patent and Trademark office and notice they have the trademark “BING!”

In my humble Law opinion, they have not got a “cat in hells chance”; the exclamation mark kills it dead.

On the other hand Microsoft seem to have the trademark “Bing”, covered for quite a few classifications.

They do not have the trademark “Bings”, and the 2 companies that applied for trademarks are now “dead” according to the United States trademark service.

There are 5 other American companies, with the trademark “Bing”, one of which, is a software company called TERABYTE, INC CORPORATION.

As to whether they have any connection with “Microsoft”, I do not know.

The United Kingdom trademark service shows that Microsoft have applied for the trademark “Bing” as a New Application for classes, 09, 35, 38, 41, 42, as well as an (EU) Trade Mark
“Status registered”U00000996700 for class 39.

There are 6 more trademarks for “bing”, of which 2 have been “withdrawn or expired”

No trademarks for “Bings”, however.

I’ve got a feeling I am OK with Bings TV. Time will tell, but like I said before.

I did not buy this domain to trade off or “pass off” as “Microsoft”

Does anyone else have any views on this subject.

Being a lawyer or studying law does not mean that you in the free and clear. Domain law and trademark law are two different things. Trademark infringement is interpretive and subjective. When combined with domains and domain law, they can make a case for practically anything.

You are immediately opening yourself up to a losing case just by mentioning microsoft in the Original Post. It indicates bad faith, and in domain law, intentions behind registration and misuse is an open and shut case. If you just forwarded it to your personal website without parking it and offered it for sale or discussion without the mention of microsoft, it would be extremely difficult to prove what your intentions were behind registering it.

Again this is just my opinion.

I understand what you are saying, however, the reason I mentioned “Microsoft” in the first part of the post, was actually to show that I knew about it.

If I had not mentioned this, then it would have looked “underhand”.

I have to say; I was surprised to see that “Microsoft”, had the dot COM, as I thought everyone thought of “Bing” only.

I am surprised they only registered “Bings” in one extension. “Why not go for them all?

Anyway, I only found this out, after I had registered “Bings.tv”.

However, I can say, I still would have registered it had I known about it first, and the reason for this is because of the following.

I have picked up over 20 first names, with an “s” on the end this last 24 months, and it was only in March, this year, that I was able to pick them up, without the “s”, however, I still have some with the “s” on the end.

I had looked at “Bing” domains well before “Microsoft” had thought of their search engine name. I thought Bing was a good name.

It has only been this last month that I have added to my portfolio with a lot more dot TV’s, because of the excellent pricing an “Name.com”, so therefore I took advantage of some domain names, that I probably would not have bought for the normal full price. Hence “Bings”

The reason I have picked up personal Christian name domains, is for a business in the near future, to offer Personalised email addresses, such as bing@*****.tv, wendy@wen**.tv, julie@jul**.tv etc.

This would not involve the domain name being used in a web site, except, maybe a landing page to explain how to buy the personalised email address.

However, if a famous person were to approach me for one of these domains, then I would sell the domain name to them in order for them to have their own personal web site.

Now correct me if I am wrong, but I am not doing anything wrong with that particular domain, and the reason I mentioned “Microsoft” up front, was to stop “dead”, any problems in their tracks.

I hope this makes the situation a bit clearer, for anyone who is reading this post.

No worries BJ. I personally don't care what anyone registers. It is what it is. I have no ill will towards you or the name, it was posted it for discussion. I think 95% of domainers have at least one suspect or maybe even blatant TM domains. Many people make their living off of TM domains as they syphon traffic away from a real site and collect clicks. I personally gave that game up a long time ago.

MS is one of the biggest defenders of TM related names. They go after 90% of names registered without exception. They do not care what your intentions are or are not. I know from personal experience. :(

Thanks Acrobat, for putting me in the picture about Ms.

I certainly hope they leave me alone as I am too busy to put up a fight at the moment.

However, if Bill needs it that much, then I will gladly give it to him.

Good luck with all your domaining Acrobat, and lets hope the dot Tv's pick up again, as they seem to have stalled a little bit this last 8 weeks.
