Asking general step-by-step instructions

Can anybody write plese some step-by-step instructions what to do if got caugth with TM issue on domain name to avoid cort or any similar problems and fees.
For example to give domain instantly to the TM holder, or to do what?

Ask them (well, bring it up..) if they're willing to settle for atleast regular price before you hand it over. Just make sure not to upset them, really.

thanks for links. just been there. OH MY. regarding how much desisions have been made to TRANSFER to compliants, any domain can be a dispute issue. How do you people handle this?
one more question. who is paying all cort fees if cort desision is to TRANSFER domain to compliant?
