The thing that I see everyone hung up on here is the 12 hour rule, which is not in effect currently with the new rules to my understanding. With a Blue Account, you get 4 bumps a day or one every 6 hours With a Gold Account you get 5 bumps or one every 4.8 hours. There is no more 12/24 hour...- Points: 4

That is a very valid point. In my opinion, If they are the actual owner, it wouldn't even fall under secondary infringement. At that point they are the sole owner and, once they receive a notice of intent, GoDaddy would be knowingly acting in bad faith by continuing the sale of and profiting...- Points: 1

I agree they should, and they have a moral responsibility to do so. However in the US, the Lanham Act is interpreted differently, in different courts and doesn't always apply to auction sites.
