A UDRP case has been filed against the domain name iBuy.com; a domain that's been registered since 1995. According to WhoIs information, iBuy.com is owned by Albert Houllou of Brooklyn and has shown the current "Coming Soon" page since at least 2011.

The UDRP case shows that the complainant is iBuy Stores Inc of Harriman, NY - a company that currently operates on ibuystores.com. iBuy Stores Inc is a company providing construction equipment, barbeques and office machinery supplies through its website.

Most importantly, iBuy Stores Inc says on their website that they've been in business since 2008; a whole 13 years after ibuy.com was registered. Aside from iBuyStores.com, the company also owns and operates iBuyFireplaces.com, iBuyGrillParts.com, iBuyBarbecues.com and ConstructionParts.com.

There is little information available to determine the size and value of iBuy Stores Inc, but judging by their large online operation, I'd assume that they're a fairly big business, and it's not surprising that the company is looking to own ibuy.com.

iBuy.com can certainly be valued at five/six figures, and this could be seen as a cheap attempt by iBuy Stores Inc to acquire the domain without paying the high price tag that would no doubt come with the name.

The case is still open, but I hope that the panel files a verdict of Reverse Domain Name Hijacking.

You may not find it interesting, however, it points to how flawed the UDRP process is. There should be guidelines used by ICANN in which filings like these should be dismissed, and the registrant should not have to stress, and spend his money to protect his domain. No ads on the site at all, and a bunch of other reasons why the registrant should not need to defend his registration.

When the company/individual filing for UDRP pays the fee, and it is quite clear that the registrant is not in the wrong, the complainant should receive a message from ICANN saying the reasons given is not adequate enough, and that filing is dismissed. The complainant should also lose the UDRP fee paid to ICANN. This would seem more fair to me, and prevent RDNH from happening. Currently the registrant needs to stress, perhaps pay for the services of someone like John Berryhill to defend himself.

Along with the complainant losing any UDRP fees paid, I think there should be monies paid to the defendant for damages in the event the complainant looses the case. At the very least, they should have to pay all legal fees accrued by the defendant.

This probably isn't going to deter companies from doing this but it would allow people who that don't have thousands to defend themselves an opportunity to rightfully stop ridiculous cases like this one.

I obviously don't agree with companies doing this but you have to ask the question, why wouldn't they do it? They certainly don't lose anything and that's what needs to change. Most larger companies usually have lawyers on retainer anyway. A few thousands dollars for the chance to get the name for cheap.

BTW, Mr. Houllou has Houllou.com. Wish I had my last name as a .com, but he also owns SHE Advertising, the same company that has the parking page at the domain reseller page. It seems he keeps all his domains at that reseller account.

I agree, this company belongs in the Hall of Shame! Probably won't be long before we see them listed there. On a side note, is it possible to counter-sue if someone files a UDRP and the case is denied? This is one of those cases you would like to see the instigating company not only lose this suit, but then have a new suit filed against them which they would be on the hook for.
