I registered the above domain recently and was wondering what you would think its value is.

While reading previous posts I understand that I might have to deal with TM issues. Any ideas would be greatly appreciated.

I would like to look more into the issue before I drop the domain. Obviously the domain refers to the operating software, however, it also has a meaning. This could potentially be the name of a business - someone who is a professional when it comes to Windows XP. In a more far stretched thought someone with experience in actual windows (windows experienced professional).

How can you check if the domain does indeed violate trademark issues? If someone tries to sell the domain to the Trademark owner in question, would it be considered "bad will". I read somewhere that this is a term they use to accuse someone of trademark infringement.

How can you start a new business name Windows Xp professional...:lol:

Dont think you will be able to sell this domain to Microsoft and get good $$$$....

I would strongly suggest to drop this domain...as per wish..

That usually doesn't fly, and forget about contacting MS to sell it to them.

On a sidenote... How is it that so many people have registered/sold "youtube" like names?

Most of them are associated with porn in one way or another. What is the difference there?

- Trademark Infringement

- Named Skill

If you're a mechanic that specializes in BMWs,
It doesn't seem fair that you'd get sued for having BMWspecialist.com

It would be a stretch for YouTube/Google to claim infringement on anything with "tube" in it. That term has been connected to TV sets from the beginning.

eBay shuts down almost anyone using "bay" in their name, but their use of the word is so unique.

That makes sense... Then again I am sure we can find other examples that could be considered infringements... Maybe ebay related or Star Wars fan pages even... It was noted that using windows in domain might be risky.. I think that's way stretched, don't you agree?

For every big online success, we get a bunch of related blogs or even fully developed sites... Are all of these "risky"? Or do they all contact the trademark owner? I am not a domain reseller pro, I do however make movies. In the film industry whenever you want to use anything related to a company you have to contact them and ask for permission or charge them for it. I thought Internet was the exact opposite cause if it wasn't, half of the blogs that are currently online are violating some sort of copyright law - pictures not owned by them, music not owned by them etc... I find it very hard to believe that everyone knows they have to or takes the time to contact the copyright holder for using their material.

Would love to hear your thoughts on that since I am really thinking of testing my skills in both domain reselling and developing.

That is probably a case of fair use. However if BMW released a car called the Specialist it would be a lot tougher for even a mechanic to justify registering the domain afterwards.

But let's assume that WindowsXPProfessional has a legit use. How many IT guys want to present themselves as "The Windows XP Professional" ? Seems ridiculous to me since they would be dealing with many more OS's and hardware.

Very true - but think of it from the marketing point of view. Say we have a new business... A generic name is as good as nothing in a way... Using a name with an already built audience can really help. Of course the name wouldn't make much sense but it's a good start to attract visitors... Or think of it as a forum to help on WindowsXP issues. Search for a mac forum and you'll get a bunch of non-Apple forums. Some with lots of visitors.. How do these exist?

my advice: drop this domain and stay away from anything that can be suspect of trademark infringement in the future.

They exist because they got permission first. You would have to get that from Microsoft. Odds...... not!

Here is how you can think about it.

Did you think of windowsxpprofessional all by yourself or did the name come to you only because you have heard of it before. If it was the first one then ?????????? (still a violation), if it was the second one then you are trying to capitalize on someone elses ideas. That is bad.....really bad!

You are only 7-10 dollars in the hole right now. Get out while you can still get a refund.
