It is increasingly hard to see how Google’s PageRank patent survives. Google might have thought that the patent system would surely protect new technological developments that are highly creative and socially valuable. The Patent and Trademark Office’s new position proves that view mistaken.

The article addresses several decisions of the USPTO's internal Board of Appeals. Historically, whenever the PTO has issued decisions restricting the range of things constituting statutory subject matter under 35 USC 101, they have consistently been overruled by the courts.

Will this have any effect on say... the "1 click checkout" type patents? The ones that companies have bilked millions out of other companies because they streamlined their own checkout processes, and the like?
