Need some feedback on purchasing and owning code.

I may not phase this properly but I will give it a go.

The Scenario would be as follows,

If I called up the programmers that coded lets say,(making this up by the way )

and said I want to buy your code to make it mine. I do not want a license, I want to say the code is mine. But I make an agreement that I will not resell it as copies. They still would have rights to sell it.

What am I asking for?

I can't get my arms around this because everything I have done we have built ourselves from scratch.

If you have an idea of what I am trying to say please post it and help me out with this. Thanks so much.

Usually people who sell scripts like that don't make you credit them for the software.

I do not want to credit them like lets say software was coded by XYZ, I want to own it and call it my own.

What is that called? Is that just simply making up a contract between us and them that states we purchased this code now it is ours?

Basically you want a written agreement which states that you have paid a little extra to remove reference to the script author. They will charge you more (than just the retail price of the script) to remove the reference to their company but this is not uncommon.

Can you claim copyright on your site for the script in that agreement? Probably not.

A little background info as I understand it (but I'm no lawyer!):

Copyright and Intellectual Property.

You want to own the code?

- Buy code for $XX - seller retains copyright and Intellectual Property of the product
- Buy same code for alot more (how much depends on script obviously) and you get copyright and Intellectual Property.

If they are willing to sell you the IP for the code then you can legally resell it. I think the IP passing to you means the script seller no longer has rights to resell that script.

I'm not clear on the re-sale rights stuff that sellers of cheap scripts offer - that is more of a handshake agreement for a little extra cash and both parties retain the right to resell the script/code.

Right.

I want to own it. Not just pay a few dollars more. I will probably have to pay alot more. Like it was developed for me.

But I have said to them that I will not resell and they can continue to resell their script.

What is that called. lol. And should that cost alot more?

Hmm going by your last thread as Hitch says all you want is copyright removed on the script. Why do you want to claim someone else's script is your own especially if they are to continue selling it?

Well I dont want to claim anything. I want to own the code. But I see what you are saying also.

If all you want is NOT to have to credit them, usually paid scripts like that don't require you to if you work out a deal. Removing copyright info from the html doesnt make it yours, it just makes it so users don't know it's not yours, which is what I think you want.

Yes I want to own the code. So if let's say Google came by and said I want to buy you out I could freely and legally do that.

It doesn't matter what script you use if the ownership of the site transfers you can usually pass ownership over. The main thing you need to check is to see how the script is licensed, if it licensed to the domain name then it is very simple you just pass over your details and the new owner takes control. If the software is licensed to you then usually the software vendor can pass over ownership in this event on your request.

Of course doing these would stop you yourself using the scripts after you sell the site.
