i went ahead and searched following link here didn't come up with anything.

There was a TM for "Red Oak Inns" but it's a dead TM:

I guess it would just come down to if it was used to infringe upon another TM holders mark. As long as it wan't used in their TM fields, then it should be ok.

The thing is though, who would be a potential buyer for the exact name you have and what would they use it for? It looks like an extremely tough sell and a very limited market, given the name and it's potential uses.

Looks like a reg fee domain unless you can find the right buyer.

Thanks for your insightful response, i have done quite a bit of research and learn a few things in regards to RedOakInn.com

1. TM registration may have expired, but if common law trademark is not limited to complying with payments and may still bar registration.

For example:
If Coca Cola stopped paying the renewal fee such that the TM registration becomes abandoned, you still could not registered it anywhere in the world.

In the case of RedOakInn; an abandoned trademark technically can be re-registered with the USPTO.

BUT

If there may be some residual common law rights that the original trademark owner has, then i can't.

It appears there is one business by this name in Vermont. You could try them for a quick flip. Maybe you could get low XXX

Otherwise you are stuck unless some other mom and pop opens an inn and wants the name.

Try for the flip and then dump it if no interest.
