Looking for a few opinions/brand ideas for a rare 6 letter word:

1996 brand domain with extremely high recall power.

if it's being sold, why did the owner just ask me to make an offer?

As mentioned above, it's "in the process of being sold" = offer has been received, funds are being wired to an escrow account.

Until the transfer of ownership has taken place and funds exchanged, the domain is not sold. In the past I have had other domain names that were also "in the process of being sold" that were not sold.

No offense but that's bad business.

It would be like making an agreement to buy a domain here at NP and then the owner offers it for sale before payment is exchanged. My guess would be in an attempt to get more money and screw the initial buyer...

The owner should have told me the domain has a pending sale so I'm not wasting my time.

I agree, that doesn't sound "right"..... I can understand that some sale agreements do not ultimately finalize in a sale. But, in the instances that I have experienced, and would make sense to me, it is when a BUYER fails to pay as agreed.... hence, no sale. But, as you have described it, the buyer has already initiated payment, which leads me to believe that a sale agreement was reached between buyer and seller and, more importantly, the buyer has already began the process to fulfill their end of the deal. For the seller to pull out of the deal and not accept the agreed payment amount and pursue the sale elsewhere (for any reason other than the buyer failing to pay) is also, in my opinion, bad business.

so Federer... no clarification of a misunderstanding regarding pulling out of a deal if a better offer was made? you "liked" that STP valued it so high but failed to address what Keith brought up.

but, you also didn't mind approaching endusers about buying (potentially TM) domains that were in a closed drop auction in which you were participating but had not already actually won/bought: http://www.namepros.com/warnings-and-alerts/543290-warning-dmg-com-snapnames-auction.html so maybe it's just a different day/different tactics. You seem like a well established and obviously successful domainer so I had really expected (or hoped) to receive a reply that clarified that, no... you are not fishing for/accepting better offers since the domain was pulled from the great domains auction due to reaching an AGREEMENT with a buyer that has ALREADY initiated payment..... it was a simple misunderstanding. Your lack of response makes me wonder though. And regardless of what the "domain" is worth, the bigger question is what is your INTEGRITY worth?

1. The domain was pulled out of GD as I received a $23,500 offer (private email) 15mins prior to the auction starting

2. Buyer agreed to wire funds soon

3. Further offers/inquiries came in (also via private emails) AFTER the name had been pulled out of the GD listing but BEFORE the deal had been finalized with buyer 1 - although I was "binding" with buyer 1 (although nothing had been signed, I had given my word), I wanted to know how serious these other bidders/interested buyers were (i.e. their offers).
That is not say I would have even considered a $30K offer if I had received one.

4. At this point, buyer 1 indicated funds had been wired

5. Next day funds had been received and deal had been sealed.

I understand Keith's frustration about the name being unlisted. There is no breaking of rules or anything unethical about removing a domain BEFORE the auction starts. It has happened hundreds of times and will always continue to happen every once in a while for a multitude of reasons.
Hope the events are a little clearer and sorry for the errors.

My issue was NOT that you decided to pull the domain from the great domains auction, knowing you would nonetheless have to pay their fee despite choosing to make a private sale.... you are correct that this is your right and can, for whatever reason you choose as seller, decide to remove the domain from the auction prior to start.

My issue was that you, an otherwise respected domainer, basically said that you pulled the domain because you received a private offer, had agreed to it and were nonetheless soliciting other offers

in my opinion a simple reply "the domain is pending sale / has been sold" would have been appropriate. Why bother entertaining other offers if you believe the offer is valid enough to forego a great domains auction (and the exposure that it affords) 15 MINUTES PRIOR TO AUCTION START, plus pay the commission? What if the other interested party you wanted offers from HAD offered something obscenely tempting?

Thanks for clarifying the "play by play"... I still don't entirely agree with how you chose to do it but it isn't my sale or purchase so not my issue per se. I think that if you had been more up front with the other possible buyers, and been more clear in this thread (rather than framing it as an "Until the transfer of ownership has taken place and funds exchanged, the domain is not sold" situation), it would have been better and less of an issue. Congrats on the sale. I will leave it at that. SP
