About 6 months ago I was in deep talks to partner with an individual who owned a couple of extremely valuable domains. We exchanged ideas via email and phone over the course of 2 months. It was ultimately agreed that we would move forward...my idea, his domains.

Fast forward a few months and I've heard nothing. His email address is now invalid. Today I did a google search and learned that he passed away just after our unofficial partnership was formed.

The domains are registered until 2022 so waiting for expiration isn't an option. What would you do in this situation?

Be fair to his relatives. Get in before the vultures do.

I would suggest what the others here have said. Try to get in touch with relatives and explain everything to them. Since it's unofficial you may find yourself S.O.L, but it would still be worth a try.

Even if they decide not to proceed with the idea, at least let them know he had some value in his portfolio otherwise when they expire there will surely be vultures around to snag them.

Using his login user and password... Or failing that his email... And then finally, calling the registrar.

Unless her deceased spouse left log-in details somewhere, she can contact the registrar for help.

Contact his wife and give her all the details.

Let her make the decision about the future of the domains (hopefully they involve you).

It's like some of the others here have said. His wife can contact the registrar and provide whatever documentation or information they need to take over the login details. At the same time, he may have written the details down somewhere and she may have access to them.

Do you know where they are regged. GD has a policy already in place. With the death certificate, they will give her access.

contact the wife, explain the value of the domains without downplaying it and ask her then to sell?

As others mentioned, most registrars are experienced with handling deceased registrants. I encountered just that when inquiring on JackRussells.com a couple years (or so) ago. The family can access the domains.

You're on tricky legal ground as far as a partnership with pledged assets and a deceased partner, prior to the partnership being consummated. As a partner, you'd be dealing with his estate. When someone dies, a lot of their obligations go with them, but not all. As far as your ability to lay claim to the domains against his estate on the basis of an agreement having been made between you at some point, you're deep into in lawyerland with that one. My mouthpiece charges $250 an hour. I'd estimate this to be at least a two hour "conversation", plus whatever it costs me to run them down in court and wrench the names out of them (way more $$$$).

If your objective is to proceed casually, that's probably the least stressful way to go about it, but it's also probably the most likely to result in a busted deal.

I've learned in life that not all deals hold up, that only children and retards get their expectations up so high about things that they become totally despondent and distraught when things go south.

If you're prepared to put up a fight, then fight. If you're not prepared to put up a fight, then inquire with his wife, but be prepared for things to not work out as you had planned. Such an inquiry is guaranteed to engender caution and hesitancy on the part of his family, guaranteed. There's no way to allay this. It is what it is.

I'm not even sure how to contact his wife since she is in another country. The domains are also under privacy protect so I don't have an address to use. Google is sort of helping...

Yes this is the way I am proceeding. We did'nt have a signed agreement so it makes sense to take the friendly approach.

In my opinion it seems that you may be out of luck. You stated that they were his domains, so if and when you are able to get in contact with the spouse tell her you may be interested in purchasing them..

Not for free.

I would like to track down his wife who probabely has no clue her husband owned the domains. If I can get in touch with her I'll make her aware of my conversation with her husband and make an offer to buy. If she doesn't sell, at least she's aware of the assetts her husband had. He was not a domainer!

Now all of a sudden he wants to make a grab for the domain by making a quick offer before anyone else - no doubt far below the liquid value - which he hopes will impress his wife/heir to part with the domain

First question I would ask any wannabe developer bringing nothing but promises to the table is:

"Show me the best example of what you have done"

Last time I checked, OP was trying to flog domains for $200

Doesn't seem like someone who has their sh t together :hehe:

Your view of the situation is as if your head was up your ass. Now lets be clear...I'm not trying to get something for nothing. I simply explained the situation and asked for advice. Is something wrong with that?

Someone trying to make $200 on a domain forum selling domains has their shit together more than someone who hangs out on a domain forum peddling anger, I'd say.
