Ofcourse you should contact them.

Their domainname is not that good.

But the fact that they have not contacted you in the first place might mean that they where not willing to spend too much money on the domain.

However that should have changed since they have now developed the site.

I can only say what I would expect to sell it for, and that would be atleast 6000$.
But that might be way to low.

Do some research about the site. Does anyone care about the site, is he very rich?

I did some research when i got the name and its seems like the are planing some thing big and the guy how own the company is a millionaire
and don't forget that he sold hotmail.com for $400 million in 1998 :bingo:

Also consider possible TM issues.

If there's a TM on the term, did you have the domain before they had the TM? If not, tread carefully.

The term MAY be too generic, BUT nothing surprises me these days.

Never ever try to contact and sell them your name. Develop a humble site entirely different from theirs. Do not park it either, as it may pick some links of their site and they find an excuse to sue you. Wait for a couple of years if you can; they will come to you. If you can’t wait, find some professional brokers from renowned organisations like Sedo. I do not think there will be any TM issue, as your domain was initially registered back in 2005. It did drop once but that is not an issue IMHO.

you could dev a site for living wills or create an online collaborative poetry site.

Remove the domain name lest it gets indexed. The xxxxx people can find this thread and can mean trouble.

Do you really think its a bad idea to contact them, but i thought you will easy form them to contact the right owner

I gave that suggestion keeping in view some past cases where people tried to sell their domain names to the people with TM and they not only lost their names but also ended up with huge amount of legal fees. I can see you have not done enough research about all this so there is no point in taking a risk. Keep your head down and develop your site. Simple is that. God forbid, if anything goes wrong, you should be able to demonstrate that you were in a genuine business. This is what domainers with potential TM issue do. Choice is yours. B-)

Do not park it any where.
Create simple page that has nothing to do with their site.
Do NOT put any adsense just in case they decide to run adwords campaign.
Do NOT contact them.
Wait until they contact you.
Renew it for ten more years and just forget about that domain!
Remove their site info and your domain info from your posts.

It doesn't mean you are clear JUST because they don't have TM.
It's all in the domain usage.

My suggestion: If there is no live trademark on this name, why not "register your own trademark" on this domain so as to PROTECT YOURSELF and get in the drivers seat!!!!

The trademark will cost you about $200, but this same $200 can translate into $XXX,XXX if you are the legal registrant and seller of this name trademark!!!

What are the benefits of federal trademark registration? Here's USPTO's answer:

1. Constructive notice nationwide of the trademark owner's claim.
2. Evidence of ownership of the trademark.

5. Registration may be filed with U.S. Customs Service to prevent importation of infringing foreign goods.


PS:

Make sure you keep all the paperwork on your trademark for future use.
Also double check to see if service trademark is necessary....
