Thank you for bringing this to our attention. Sadly we were unaware that they had copied our terms of service. While they may have gotten approval to use our terms of service through someone else (we allowed a couple resellers to use it) this will be dealt with.
I have confirmed that they copied our terms of service early this year (confirmed this with archive.org as their TOS for 2004 was completely different). You can check this out yourself by visiting archive.org and typing in the 2 domains and checking out the terms of service. But don't be fooled, make sure your looking at the right archive (and double check the date in the url).
