I just saw this on a For Sale page...

Get On The Web Limited does not knowingly register and/or offer for sale domain names which are registered trade marks. If you or your organization own any registered trade mark relating to the above name or any other names Get On The Web Limited has registered, or if you represent or know of any such organization, kindly inform us as soon as possible. Get On The Web Limited shall not be liable to the owner of any trade mark or prior right nor to any agent acting for such persons for any direct, indirect or consequential losses suffered as a result of your failure to notify it of your alleged or actual claim or for any direct or indirect losses arising as a result of registration, use, offer for sale and/or sale of the said domain name by Get On The Web Limited.

Does this kind of disclaimer carry any weight?

Not really, what it does mean is that the domain owner knows they registered TMs and are familiar somewhat about the implications for doing so. They are claiming ifnorance when in fact, when every registration, you must abide by the TOS of the registrars which basically states it is the domainers responsibility to not register TMed domains.

Yup.

I always like a statement at the bottom page of something like Cocca-cola.tld that says, "By visiting this webpage, you admit and agree that we are not cybersquatters."

They could have made a much shorter disclaimer to say basically the same thing:

"Caveat emptor"

I never knew TM was such a big deal. A couple of weeks ago a friend of mine got a *googlesucks type of domain.

There are plenty of companies out there with a staff of lawyers ready, willing, and able to bring you up to speed.

Yeah I stopped placing those disclaimers on the bottom of my sites years ago and I don't advise anyone else do it either. They are fairly worthless and as pointed out...can actually be harmful. The WORST thing you can do is admit that someone else has rights to your domain and that's exactly what that does.

I hope my post is on topic. :)

I love those types of "by visiting this page you agree..." or "by reading this email you agree..." disclaimers. As if we could possibly know that there was some sort of contract we would be required to accept BEFORE we even knew what the hell we we're viewing...

Especially since the disclaimer is usually at the very bottom of the page or email, meaning you've already read the entire thing BEFORE you were presented with terms....

Some people just don't think.
